I am just not sure how you come up with actual text from a citation when both the cited rule and the text do not exist. AI has been known to make stuff up out of thin air when it can't find actual references to cite.

Yeah.

I have actually seen that in a brief once upon a time way before AI. Council cited a local rule for CAND in TXED. Both courts have special local rules related to patent infringement cases, and many of TXED local rules are adopted from CAND, but they are not the same.

But, it was one citation, not a host of them, so the present instance may or may not have been AI abuse.

I was objecting to how an actual human could come up with actual text from a fictional citation if they were not using AI.

I deal with the federal judiciary. They sent a note out yesterday saying that due to the shutdown they will be closing courts as soon as next week.

Could be part of the play by team Trump.

Incredibly disheartening, isn't it?

To paraphrase Gorsuch, good judges do not always personally agree with all of their decisions because the law is foremost.

Today's federal judges put their personal political agendas and feelings before the law.

To what end? Does it reach a point where we see sanctions / removals?

Sadly, I don't see it, but what I do see are some unintended consequences. Do we start seeing cases like Little v Hecox, VRA, etc backfiring because they pushed too far and now a conservative Supreme Court is going to set precedents? Hell, that Judge in Illinois forcing the Federal government's hand is probably going to backfire and set hard guardrails ... massive overreach, and if I am being honest, I don't like anyone doing stupid **** that erodes State's rights even if, in this instance, I want him slapped into oblivion.

They didn't want it to go to SCOTUS, so they dropped it. But that is not how it works. Now SCOTUS WILL hear it.

And Nachmanoff claims Fitzgerald's conflict was obvious years ago because of the 2019 DOJ IG report identifying him as a conduit in Comey's leak of confidential, and in some instances, classified information?

This is ABSURD. And it reminds me of the time Judge Chutkan told Trump's attorneys in the J6 cases they should have been reading discovery evidence in the case BEFORE the indictment to prepare for trial--referring to the J6 committee report and news coverage.

Hopefully a motion to recuse is forthcoming.

One good thing about Trump's second term is the defanging of the judiciary. These federal judges have only been able to delay his agenda slightly. They certainly haven't been able to stop him. Now everyone can see that.
