Questions about silencers and trusts

My cousin has his own trust in his name, and has a handful of silencers he purchased in the trust. I was added to the trust when he established it.

I want to get a silencer in the next couple of months and need to know what process I need to do to purchase a silencer and have it put in HIS trust?

Do I need to go through the same background check rigamarow as he did or can I just purchase the silencer and add it to his trust?

I have been told by some that all I need to do is purchase the silencer and pay the stamp, but I would not have to do all the background jazz since it is going into a trust that is already legal?

This is confusing and luckily I have some time as I am going to wait until after the first so I don't have to pay for the tax stamp. SO, after the New Year, what will I have to do to purchase a silencer and add to a trust that I am on, but not the owner of? Thank you for any insight.

If you are both on the trust you would purchase it and pay the stamp under the trust but you both need to have fingerprinting done anytime anyone purchases a new nfa item

If it were me I'd start my own trust. Silencershop will do single silencer trust for $25. I had a friend set up a trust and get a silencer through the nfa process in a week. This was a couple weeks ago. No need to add your silencer to someone else's trust.

What is best to do for my son and I to share a trust? He will turn 20 in May, can he be part of the trust?

Next question will open up a can of worms but going to ask. What brand of silencer? What about attachment? Screw on. Initial ones would be for a 6.5 creedmore bolt action and a 556 AR platform.

So we would both need to go into the shop at purchase and both get fingerprinted? Just curious why he would have to continue to get fingerprinted if he can show the trust paperwork and proper ID? I am not questioning you, just trying to further understand the process. Thank you.

You have to get finger printed with every purchase and every trustee has to do it each time.


For the other poster asking about his son you can either add him as a co trustee but go through th le fingerprint rigmarole with him or start his own. Or just get everything in your name and put him as a beneficiary which I believe allows him to inherit items upon your passing

Can my 19 year old son have his own trust and purchase one or does he have to wait until 21?

If we have to wait until 21 can I put him in a trust with me and he be able to legally use the can(s) in that trust?

Is there any advantage to having all suppressors in a single trust vs the single trusts for each one? Does my dad need to get fingerprints at the same place I do or does any silencer central kiosk work?

If you have a trust with multiple people in it I believe each person will have to be fingerprinted in order to buy a suppressor (wasn't that way when I originally set mine up). The way around that is to do an amendment removing everyone but yourself from the trust & purchase a suppressor. Then at a later date you can add them back.

another Q, maybe speculation, but the tax stamp goes away officially on 1/1/2026, right? Will that drive up demand so much that the actual paperwork takes even longer? ...better to pay the $200 now while there's not wait vs save $200 in a month but possible wait for months to get the can out of jail?

Yes so I did an amendment to remove my wife to avoid the hassle of all that and just made her a beneficiary instead.

Silencer shop will let you buy now but not process till January to avoid the tax stamp...

Do you have a copy of the trust? What is your role/title in the documents?

I have a cousin with a trust too. Good guy. If I buy a silencer I'm putting it in my own trust - zero chance I'm adding it to his.

You used to be able to make a trust, add whoever, and they'd only have to be fingerprinted once.

Then our lovely ATF decided that wasn't enough infringement, so everyone on a trust has to be fingerprinted every time an item is added to a trust.

The fact that the same person has to get fingerprinted and BCG'd every single time is maddeningly stupid. Just like it is beyond stupid that you cannot put multiple cans on an application and have to do an application, with fingerprints and a backgeound check, for each item. Just like it is stupid we have to do an application to begin with.

Oh, and the BCG is EXACTLY the same one you go through when you buy an actual firearm from an FFL dealer. Zero difference at all.

Remember kids - your government hates you and you cannot hate or distrust it enough.

Put them on a trust. Make yourself the only trustee at the time of purchase. Add additional trustees after the fact so they can use the can without any issue. Remove them for the next purchase. Wash, rinse, repeat.

It's all stupid, but just get an .eft file done for your fingerprints so you can use it for future purchases.

I doubt the tax removal drives demand much. Registration is the is the main demand restriction. I would own a bucketful of suppressors if the registration went away and the tax DOUBLED.

I'm hoping so but expecting the worst. Have a suppressor on order with a January delivery and worried what wait times might end up being. However, my first two were done back when everything was paper and turnaround time was 9-12 months, PLUS $200. Anything is better than that.

I've got to decide if I want to do this one as an individual or under my trust. Don't really want to have to get everyone in it fingerprinted (brother, his wife, my wife).
