You may want to narrow down the type of civil case. Family, custody, car wreck, construction, employment, etc. My experience is that its horses for courses, particularly with the civil defense side.

Ah yes, good call out. Father was threatened with a lawsuit for running over a coworker's foot as he was about to give him a ride so what is that? Personal injury defense? Is that a specialty? I don't really know. The only guys I know are on the employment and contracts side of things.

It sounds like a car insurance claim to me unless there is way more to the story than that.

Agree. Depending on the circumstance, either car insurance or employer would be the ones to defend him.

If he ran over the foot intentionally, then he would want a criminal lawyer as well.

The coworker directly threatening him with legal action is probably not the best approach for the coworker.

If it was his personal vehicle report it to his insurance carrier. They will try to settle the case, and if not, owe him a defense.

If he was operating the company's vehicle notify management and let them report it to their Workers's Comp and Commercial Auto carriers.

Appreciate the insight. Got more info today and an auto claim was filed. The threat to sue him was prior to that. All this was strictly accidental on company property but not with a company vehicle and there were several witnesses. Plot twist, he actually did end up suing the company according to my dad but he doesn't know what for specifically. The owner (small company) told my dad as a heads up knowing the guy had threatened to sue my dad. My dad shared that shortly after the accident the guy was let go but that it was for performance and absenteeism. Sounds like to me he is just looking to somehow cash in with everyone and their mother. Idk the whole deal seems odd.

Sounds like your dad should be covered by his auto insurance. Keep in mind he may still get sued directly and served with the suit, in which case he needs to just send it over to the insurance company.

For the business owner, that's a tough spot. Unless they created an unsafe environment on their property, then they "should" not owe anything. But plaintiff attorneys will chase anything injury involved and then add in a termination within the same time period. Regardless, business owner has to pay his attorney to at least respond.

That's money that could be spent on employees or investing in the business. Contingent legal fees should be made illegal.
