Recs for an Estate/Family attorney in North Dallas

Father passed. I'm the executor. Simple small estate.

I know his intention was to avoid any unnecessary fees, but my research says, the state will force me to probate and probably to hire an attorney for that process.

Looks like I need to talk with and hire someone.

Best bet to not incur a ton of fees from a probate attorney, is to not do it in your area. Find a smaller town attorney as their fees are typically much more reasonable.

My sister's firm is probably too far a drive (though most can be done through email), but if you get a wild hare to go to Cleburne, Holmes and Shanklin is the firm name.

At this point, I'm not sure what I don't know. First step may be to simply speak with one to find out the true facts and steps.

Think she might do a quick phone consult for whatever that goes fo these days?

Tell her that her brother told you on TexAgs and she might do it for free. She's class of '04

I think most counties will require you to have a lawyer at the probate hearing. You want to hire one who has experience in filing for probate in the county your father passed away in because it seems like every judge runs their court a little differently so that experience will just help make things go smoother.

In my case I was filing in Denton county and I used Jeff Yates who is an Ag who has posted good information on this forum in the past. The price he charged was very reasonable and he talked me over the phone for about half an hour before I even hired him to give me a good run down of what to expect.

+1 for Jeff Yates. He's helped me out with some estate planning things in the past. He'd be fantastic. Looks like he still posts occasionally as Dilly Dilly.

Thanks for the props. Always glad to provide advice and help out if needed. The Estates Code says the probate is to be filed in the county where the decedent resided. If you are probating the will and having an executor appointed, you have to have an attorney (the judges see an estate like a legal entity where you can't represent yourself). Regardless, if you're in Dallas County, a lawyer will be invaluable to get through the quagmire that is their system. There may be some options short of a full blown probate under certain circumstances that I'd be glad to discuss with you as well. You say North Dallas. If its NOT Dallas County, I'll be glad to help you. Sorry, but I don't do Dallas County (anything) anymore. I just can't stand it. But I'll be happy to handle it in Collin or Denton county if he resided or passed in either of those counties. I've just completed the process for other clients, so it would be as quick and painless as possible and I'd probably be a little less. We could probably even discuss a flat fee if you like (not including expenses).

Not topic related, but thought I'd post here since I've worked some of you, I'm appreciative of the feedback and don't want someone on the ticket exchange just flipping for a little money.
