I need some help in finding a lawyer for a civil suit my wife was just served with. There weren't a lot of details in the suit, but it was for rear ending someone and driving off just about 2 years ago. Only thing is, she didn't hit anyone. In addition, in the suit it lists her maiden name and her old address. What I think happened is the car we traded in 3 and a half years was involved and they pulled the old title information from the license plate. She bought that before we were married, so it would have that old information. Or something like that. I know you can report to the state that you don't own a vehicle when you sell it to a dealer. That's what I thought I did, what I asked about, and what the salesman told me I did. Since I literally signed 7 documents regarding the trade in and one of them had a State of Texas seal on it, I thought it was done. But now reading closer I realize it probably was not.

Anyway, lesson learned. Hopefully, a letter from an attorney clears this up. But in case it does not, I'm not sure what kind of lawyer I should be looking for.

Saw this link but not really sure if Hamilton Rucker or Clive Markland type practices are what I'm looking for. Since we weren't involved at all, I'm pretty sure there is no point to involve our insurance.

Contact your auto insurance company as they will have lawyers on staff.

Under no circumstances should you talk to that other lawyer. Thats what you pay your lawyer to do.

there is nothing wrong with calling the lawyer that sued and explaining the situation.

he very well may drop the case if OP can provide documents showing it was not her car at the time

hell, once he sees there is no insurance covering the claim he may drop it.

Let your lawyer do that.

Under no circumstance would I ever talk directly without representation to a lawyer who just served me.

You are probably correct, but it does not hurt to send in it. They will likely deny coverage since you did not own the car.

As BMX said, there is really no harm in calling the attorney that sued your wife and explaining the situation. If that does not work, circle back and I'll write a letter for you.

Yes the OP doesn't have a lawyer but the other party most certainly does if his wife was served papers for a civil suit.

I wouldn't do it. Just like I wouldn't ever voluntarily speak to cops without representation guilty or not.

What Panama said. There's no harm in telling the other attorney it wasn't you and simply explaining the stuation. Should be a relatively easy fix.

I don't have the information in front of me, but I seem to recall the firm being "The Law Offices of Luis Garcia". Address is 13364 Woodforest Blvd, Houston, TX 77015.

Thanks for the advice everyone. I need to think on contacting them directly. In their filing, they basically got nothing right. Not the name, not the address, not the event. On one hand, maybe it resolves the whole matter without any more trouble for anyone. On the other, if it doesn't and I end up needing further representation, then I'm sure that person will not be happy about me having this conversation without them.

You call them directly and tell them the truthful situation, you are just giving away your genius defense. Now the other guy will have all the time in the world to figure out a way to counterstrike your only move and you will never get to see the surprise and defeat in his smarmy eyes when you bust his ass in court.

You need to refer this to whoever insured you when the wreck ostensibly occurred. You paid for them to deal with this, regardless of whether you continue to use them now.

There's very little chance a lawyer would give the time of day to speak to someone no billable hours are tied to.

And the lawyer is delaying his pay day if he goes after someone that didn't actually own the car and wasn't in the accident.

He only gets paid when they find the right person and sue them...It's in that lawyers interest to get this right as soon as possible.
