See that he is participating in spring practices. Wasn't he arrested on illegal substance posession. I have not seen any mention of this affecting PT.

Didn't his vape pen have thc in it?Eagle78 said:
When I heard the reason for the arrest I couldn't believe it. They busted him for having a vaping pen he purchased at a store. Beware buying any of those things you see in gas stations and convenience stores and liquor stores. May be legal to sell but apparently illegal to possess. At least in tge eyes of the College Station police!

Just because you can buy it doesn't mean it's legal.Bunk Moreland said:
If it was a D8 or D9 pen legally purchased in TX then he's he's allowed to have it.

"Finally, the cheapest way to test for THC is through Thin-Layer Chromatography (TLC). Producers, sellers, and vendors often use TLC because of the low testing cost. TLC has far lower sensitivity. TLC is more qualitative than quantitative, which means it is better at indicating the presence of a substance rather than accurately measuring its concentration. This can lead to underreporting when precise quantification is necessary, as TLC might not provide the exact levels of THC present."

I think it is always on the government to prove guilt. Defendant is always presumed innocent otherwise.Sparkie said:
According to Google, Texas law allows the cops to make the arrest since they don't have a test to determine the amount of thc present. It's up to the defendant to test and prove the amounts is legal.
i thought that was obvious. it's the fact having a thc pen puts the the user at risk having to defend the amount it contains. but, the defendant has a chance to buy it from resellers who used a cheap inaccurate testMagnumLoad said:I think it is always on the government to prove guilt. It is never up to the defendant to prove anything.Sparkie said:

Fun fact, the DPS lab does not even test personal use amounts of marijuana for THC anymore. Most of these offenses will be dismissed by just saying you want to go to trial. The prosecution will not have the evidence needed to prove it is an illegal substance.
To counteract this, most DAs offices in Texas will offer you a sweetheart deal of time served to plea guilty so they can get a conviction. They will tell you max penalties and fines blah blah blah. If you get arrested for a small amount of marijuana you won't beat the ride but can totally beat the wrap in Texas.
