Looking for help…

We have had an issue where a non-responsive medical provider was negligent in delivering treatment (just MIA) which led to an emergency hospitalization.

The beef is with the medical group itself, not necessarily the doctor.

We aren't looking for some lifechanging settlement. I just want them to clear whatever balance I might owe at their office and cover the costs of the ER visit.

I've already sent them a letter documenting everything (dates, names, appt times, etc.). My attorney doesn't work in this area but said that based on its content the medical group should be scrambling to help me. I gave them a deadline of today and they have not contacted me so I am ready to escalate.

I do medmal but I'm in Ga. Don't know anyone in San Antonio. A lawyer is not going to take on a medmal case for those damages. They are very expensive and difficult.

- complicated science
- you go against the best lawyers in the State.
- expensive - you usually would have to hire cardiologists to testify against them. Local docs won't do it, so you have to go out of state to find a doc to testify. I just flew to NY for a depo of a doc Wednesday. $$$

I wouldn't take on a cardiology case unless there was death or an otherwise severe life altering injury.

I was successful in combating a similarly frustrating, expensive, but not life threatening or deadly medical issue a few years ago by sending a certified letter every time they sent me a bill outlining the piss-poor care they provided and the additional expense I incurred as a result of it.

I'll admit the contents of the letter was mostly therapeutic to me than it was as a legal threat, but they eventually stopped sending me bills and I haven't seen anything hit collections, so at least I won a small victory.

I did seek attorney advice for a lawsuit to hit them a bit harder to recover all $ I paid them, but was advised the same as GeorgiAg suggested. Nobody was willing to take the case b/c it would take more time than they'd make in money.

You could always threaten to post a really scathing review on yelp, google reviews, etc. Tell your PCP office that whatever facility you were at wasn't up to standards and they shouldn't refer people there.

You'll have a hard time finding an attorney to take the case in Texas. They're expensive to pursue and the state caps the amount of recoverable non-economic damages at $250k.

I know you're not looking for big money but the attorneys you're asking for are.

I agree with what others said, med mal cases are tough in Texas. Lawyers will only take your case if there's substantial damages and proof.

Appreciate the feedback from everyone. My letter apparently left a strong enough impression that they are waiving any remaining balances owed.

Congrats. Most private doc offices will waive fees just to get you from complaining, give a bad review, or having a bad experience. Most well run ones will write everything off b/c they know the small loss is made up for by future visits/referrals.

I forgot that I did do this. At a follow up appointment month or so later they told me the entire medical group got together and the head doctors that owned the practice instructed everyone to no longer refer patients there.

I was pretty happy about that.
