Easement Abandonment Question (Tarrant County)

Hello all,

I am at a loss on this situation and hope that someone more familiar with easements can shed some light.

The plat is for undeveloped land in Tarrant County (7400 S Cooper St, Arlington). There is a state of Texas drainage easement that is "to be abandoned' (top right hand corner of image).

The city and state can't help but said the Tarrant county real estate records could. Went there today...no dice. We did a good chunk of concrete work about 12 years ago that I thought alleviated this easement; just need to prove it.

Can anyone tell if this is easement is abandoned and/or where to find this info? Happy to provide whatever clarifying info I can.

If it's in the county, I would think the Commissioner's Court would have to formally abandon the easement in a meeting. Check the minutes of the Court. If it hasn't been abandoned, you can ask them to formally do so. They may, they may not.

I'm not an expert, but there's another abandonment note on that plan as well, just to the left of the one you mention. Looking at the aerial view of the location it looks like both easements were built over to put Scarborough Rd through to the neighborhood. Is that correct?

I would ask the surveyor for the source supporting the "to be abandoned" notation. I don't see any recorded documents that mention this.

Since it is along FM 157 (a state highway), I would call the TxDOT District Office in Fort Worth and ask them if they have abandoned the easement. Just because it may no longer be used by TxDOT for highway drainage, there still may be a process for them to release their easement interest in the land.
