Any family law attorneys out there? My kids are on spring break, and my ex has the kids

So, now that CSISD has cancelled schools for the week does that mean that she gets to keep them until school resumes? I am asking my attorney, but I haven't heard back yet because he is on spring break. Anyone with a legal background have an idea?

What are the rules during the summer, winter break and spring break? seems like it should default to that set of rules

ok, but it says it doesn't end until 6pm the day before school resumes. School isn't resuming yet.

I would argue that she would retain custody for the original time of spring break. Then, when the original spring break would have ended you would get custody back as the kids are no longer on spring break and that the schools are just closed. Hopefully your ex isn't being that much of an low life and can remain reasonable. I'm not a lawyer but I'm going through similar situation. My ex can be reasonable when it comes to the equal custody fortunately. Good luck Brother. Keep fighting if she is trying to keep them. Kids need their Dads just as much as they need their Moms.

School resumes when it was scheduled to resume after spring break vacation based on the school district calendar.

Cancellation of classes starts on the day school was to resume.

With school cancelled, you would follow summer break schedule if you have a standard split schedule (e.g., 2-2-5-5 or 2-2-3).

If you live in different cities, talk to your attorney.

I'm trying to find it but a law firm in Dallas tweeted that custody follows the original schedule posted by the district.

If this line of argument works out. Then what will happen in June if school is back in and extended to make up for missed time?

Edit: I guess by then a new 'revised' school schedule will have been published. Nvm.

When I practiced family law my least adhered to advice was "don't be a dick." When events that create school closures and change the way we live for a bit, that will require parents to work together a little more than usual with kids being out of school. Your kid will see how you react to these things and either imitate them or hate you for your response. Make sure it is the first option, and make sure it is the kind of behavior you would like to see in your kid.

School wont be extended beyond any inclement weather days. Districts can apply for a waiver from TEA to just excuse the missed days. Because Gov. Abbott has declared a statewide disaster, TEA is going to grant the waivers. It similar to what happened to Houston area schools after Hurricane Harvey.
