Despite their idiocy, a local couple and the places they visited remain anonymous.
KTXS Coronavirus Patient
Quote:

An Abilene coronavirus patient and his wife are being forced to quarantine after refusing to do so.
City Manager Robert Hanna said the man -- who's in his 40's and tested positive on Sunday -- had traveled to New York with his wife.
Hanna said the couple did not self-quarantine when they returned even though he was symptomatic for Covid-19.
They even went about their daily lives after he was tested, said Hanna.

"This kind of behavior is irresponsible," said Hanna. "This is the kind of behavior that makes other people sick."
The couple is now being monitored 24/7 by law enforcement.
The couple live only a couple of blocks from one of my best friends' home. Supposedly they are receiving ankle bracelets after a local policeman has been parked in front of their house to enforce their quarantine.

Play stupid games, win stupid prizes.

There is a serious civil liberties question with the COVID situation, generally. It needs to be asked and answered ASAP.

It really sucks that the police have to watch them.

I totally get why, but it's sad they have to get baby sat.

How is this different than driving at night without brakes and lights on a crowded interstate?

It should be pretty well spelled out by law what the state can do.

I can go shoot my guns any time I want to. Asking me not to shoot towards my neighbors house is not "restricting my civil liberties ". It's common effing sense.

A guy in Amarillo a few years ago decided to weld a pipe fence on his own property, in a field of tall dry grass, on a day with 50 mph winds. The result was 28 burned houses and several people seriously injured. Surely his right to be an idiot was built into the constitution, right?

Morons knowingly spreading dangerous diseases is no different.

When your actions endanger the lives of others, your actions are not constitutionally protected.

Not for the people who don't want to end up hospitalized. It's like smoking in public but amplified.

It's stupid. If Hipaa is the reason maybe we need to modify Hipaa. You should lose your right to privacy of your PHI the moment you do stupid stuff like that.

Actually, it is more like having sex with someone without telling them you are HIV positive. Not an automatic death sentence these days, but do it enough and you will likely cause someone's premature demise.

There are various public health and safety exceptions to HIPAA, including notifying someone who is believed to be at risk of contracting a disease. So, it is possible they've notified certain persons who may have interacted with them.

As to telling the general public, I don't remember if you can find an exception for that. But while I am curious, its also somewhat immaterial to me, up here many miles from Abilene, what their names are.

Sex is consensual (right?) and with some degree of risk (STD, pregnancy, other is clingy), getting coronavirus is not.

I think the answer is easy, but I do hope for the sake of due process and establishing a precedent that this gets addressed.

Quarantining people with a communicable disease, and in this case a potentially deadly one, is well established under US law.

Now, the shutting down of entire counties, cities, and states, with threats of imprisonment and/or fines for even setting foot outside your house is a completely different issues and needs to be addressed in the courts and eventually with the voters. If the voters don't like it, we can vote these local tyrants out in the next election.
"If you will not fight for right when you can easily win without blood shed; if you will not fight when your victory is sure and not too costly; you may come to the moment when you will have to fight with all the odds against you and only a precarious chance of survival. There may even be a worse case. You may have to fight when there is no hope of victory, because it is better to perish than to live as slaves." - Sir Winston Churchill

I was referring to your second paragraph issues more so than the first paragraph issues, notwithstanding the content of the OP.

I have not formed a strong opinion one way or another on the matter, but it would be helpful if there was some clarification quickly.

You and the poster you quoted seem to be confusing the quarantine of a confirmed infectious patient with generally quarantining people without knowing their status. These people are confirmed cases and the government has years of case law on their side in this situation.

That's because she repeatedly returned to the very activity that got people sick - cooking. I'm not discounting the fact that she was in a terrible position - cooking was her vocation and in that day nothing else she could do paid as well. But she deserved to be locked up when she showed she would continue sickening people.

State governments have very broad power to protect the health and welfare of the people. That is different from the federal government that is supposed to have limited power. Of course the limitation is usually ignored by claiming that the power asserted somehow invokes the commerce power.

No, he said "generally" and I agree. I'm a big-government loving libtard. If it were up to me, we would've had mandatory masks for everyone on day 1. Despite that opinion, I'm also very glad that our government has checks and balances in place to prevent overreach. Is this overreach? I don't think so at all, but I respect due process and minority rights enough to want to see it asked and answered. People who think this is overreach are in the minority today. I want their voice heard because someday there's no question I'll have a minority opinion on an issue I find important.

And she was offered the chance to have her gallbladder removed which is where they doctors believed the bacteria were hiding, but she flat out refused. Turns out they had been right and removing it would have meant she wouldn't have had to be quarantined for life.
