New York State ordered nursing homes to admit and readmit COVID+ patients

The state KNEW how dangerous COVID cases are in nursing homes and long term care facilities and yet the state forcibly introduced COVID cases into such communities.

It reads like a legal warning against discrimination because that's what it is. The order effectively makes patients contaminated with a highly contagious disease a protected class, akin to the way bias is banned along racial and gender lines.

The concept is obscene. For the same reason that you don't strike a match near gasoline, anyone carrying the virus should be banned from nursing homes, not forced on them.

In plain English, nursing homes cannot even ask whether a patient coming from a hospital has been tested for the virus or is positive. Unless the referring hospital volunteers that information, nursing homes must wait until the patient arrives and do their own tests.

Even then, the state wasn't done creating chaos. Officials sprung the order on the facilities without a moment's notice.

"There was no planning, no thought process to give us time to identify buildings and establish units," one industry executive said. "It happened so quickly."

In their defense, there has been a huge issue of patient dumping from nursing homes who refuse to accept patients until testing is done but the patients don't qualify for testing (this was an issue initially when we did not have ready access to testing). A hospital cannot just indefinitely hold onto nursing home patients. By boarding them in the hospital, you are increasing the likelihood of them being exposed to COVID.

I ask those that are upset about this to give an alternative to what should have been done. Keep in mind that this was done at a time when testing was not available to most and was largely controlled by the CDC. In the ER, I was seeing 1-2 patients a shifts that were sent from nursing homes for CV testing without symptoms or symptoms that were clearly not due to CV. In late March, I had absolutely no way to test them given that they did not meet CDC guidelines for testing. So they had no indication for hospital admission and no indication for testing. What would you have liked us do for these patients? Or in the case of CV+ patients, that no longer requires hospitalization, what would be your plan with those patients? Unfortunately most cities did not have a plan.

Were there other symptoms that caused the nursing homes to send them to the ER?

There was a reason they were sent to the hospital, I assume because they showed symptoms of corona virus.
There should have been provision to have dedicated facilities for these folks, not re-insert them into the mix all over the area.
I dont think anyone would think that you, the individual Dr., made a bad decision. The people that were running the show failed horribly, in my opinion.

I agree about the failure to the general public; however, this was done due to not having an immediate alternative. It takes weeks to set up facilities to care for these patients. In the mean time, hospitals can't hold onto patients that don't need to be admitted, and couldn't test patients that didn't meet testing criteria. Nursing homes also can't refuse to take their own residents back if the hospital believes the patient does not require hospitalization. This is an unfortunate Catch-22. There was no alternative option at the time for most areas. I'm sure they made this order in response to numerous nursing homes refusing to take back their residents leaving these poor individuals in limbo, and placing them at higher risk of contracting COVID by keeping them unnecessarily in the hospital until a facility accepted them.
