From what Dick Yuengling told my brother (yes, this happened) he has the oldest beer label in the US and refuses to change that for some asinine rule the TABC has.
I honestly don't blame him. It will be here eventually and until that day we will just have to go to LA to get it.

they wouldn't have to label it as an ale because it's not above the min abv that Texas requires you to call an ale, which if I remember is 6%.
Even if so, a completely new label is not required. Just a small blurb 'ale in TX' like the Samuel Adams winter lager.
