Speaking as a non-practicing attorney, I can say with confidence that you should not take seriously any assertion made in court by an interested party, as it will inevitably be a self-serving slant on the truth. Specific to the Fox News case, it was an argument that Tucker Carlson's opinion/pundit show was engaging in exaggeration and non-literal commentary, and that viewers knew that going in.
