My assumption too since there is a double jeopardy issue if they agreed on acquittal on at least one charge. Defense counselwould have insisted for it as well.
Based on the letter presented, it sounds like the defense wasn't consulted on the issuance of mistrial, and their request for jury polling was denied by the judge?
Edit: I was able to go back and find video of when the judge declared the mistrial. As it's been posted earlier, she had the jury return to the court room. She then read the jury instruction stating they are deadlocked, and then she immediately declared a mistrial. I've not been able to find any clips showing if the defense requested to know about the jury possibly being unanimous on not guilty on any counts.
