the AP says its case is about an unconstitutional effort by the White House to control speech - in this case not changing its style from the Gulf of Mexico to the "Gulf of America," as President Donald Trump did last month with an executive order.

If I remember correctly, during the first Trump administration when they booted Acosta, the court told them they had to give back his press pass at least temporarily on fifth amendment grounds, but never reached a decision on the first amendment.

I'll be honest. I think the whole thing is stupid. I agree that Trump can change the name if he wants and can exclude people from white house press briefings for any reason he wants. But I did a zoom talk for a group last night, and I called it the GoM repeatedly because I have called it that for too long and I don't plan to exercise the mental gymnastics to force myself to change what I have been calling it for my whole life. Maybe that makes me a bad person, but the whole exercise just comes off as petty to me, in the midst of a lot of winning going on with other much more critical issues.

I can't recall a time i have ever referred to it by its full name. To me it's always been the "gulf" nothing more. I'm old enough I'll probably slip up and call it the GoM. Hell, i could call it the Gulf of (insert my dogs name here) by accident.

Yeah, I typically use "the gulf" in general discussions, but in this case I was talking about continental land mass development and tectonic plate movements over the course of geologic time on a global scale, so I needed to be specific about which gulfs I was referring to.

I could not find the actual TRO, but reading some news stories there was a DC circuit case from the 70s that said "undoubtedly" giving a White House press pass conferred a libert interest that could not be deprived without due process.

Judge Kelly said that because the White House did not give Acosta notice or a chance to appeal, they denied him any due process, so they had to temporarily restore the pass.

The White House then just dropped the whole thing

That is very fake news.

I wouldn't necessarily bet against AP on this one. It's not the strongest 1A case, but I can see the 1A concerns here.
