Some statutes require the law to be knowingly violated. An illegal border crossing is not one of them.!

Magistrate judge statute should be revisited as well, if we had a functioning congress. This Wormuth clown was just appointed this month by the court to a fresh 8 year term.

I think these folks should be subject to much/at least some political oversight by the Executive branch, which isn't really the case today, if they are going to be political operatives as well as the district courts, as here.

The discretion to prosecute for not comes at the prosecutor level. Once that is pursued, the judge applies the law to the circumstances. The judge doesn't get the latitude to make up the law as they wish it was, or shouldn't. That is for the legislature and the voters.

And that is why they are still incarcerated facing charges for being in the US illegally, and for crossing the border illegally.

This only addressed the military zone. In a trespass case, you have to have notice that entry to a particular property (not country) is forbidden. And the property owner has to provide notice. The Judge here said the notice was inadequate.

I'm not saying it was or wasn't, but that's what the ruling was about.

Again, the judge did not throw out the illegal entry charges. Those are still pending, and will probably end in deportation

The question leftists can never answer on this topic, is what would happen in any other country? They know the answer but they just can't say it because it blows up their whole outrage narrative. If you are illegally in another country for even a minute longer than allowed, they will deport you…or worse.

My wife and I overstayed our visas in Indonesia by two days because a freaking volcano erupted and closed the airports. We were required to travel to their immigration center or whatever it's called and explain to them what happened. An official from the US embassy had to be there to assist us dealing with them. Even when we had proof of our canceled departure flight and proof that we rebooked the earliest possible alternative, they still treated us VERY strictly and acted like we had done something terribly wrong. It was a little scary TBH.
