A few days later my wife called me and told me the interest rate was about 1-1.25% higher because it wasn't our primary. I was really surprised…and had NO idea this was the case. But we moved forward, because we did not lie on the application.
Just my opinion, she lied. And if she didn't realize she filled it out incorrectly, the mortgage broker should have caught it. But once she signed, she's on the hook.
This is a no brainer and she knows it. But now the politics will take over (in my opinion).

And what about the emails where she explicitly stated that it wasn't going to be her primary home? That would seem to defeat any intent element for this crime.
Then the simple solution would have been to fill out the form accurately. If she email the underwriter you may have a better argument.
