Regardless if anything happens to Kelly, dragging him in for a court martial on this issue is a good move.
It nips the purpose of the video in the bud immediately.
It sends a message that the administration will not stand for insubordination, and you had better be 100% sure you know what you are doing if you fail to follow an order, or you are going to be court martialed. This administration is not playing around.
So, even if nothing happens to Kelly, this reaction is a good move, in my opinion.

You are welcome. The UCMJ is a completely different animal than statutory criminal law. It is more a Code of Conduct for military members (and their families as active duty are held responsible for the conduct of their dependents) that is 24/7/365 not just work related.
Even first amendment rights are curtailed in that you can say what you want but not when active and in uniform.
