Yes, those are what I meant by not being able to mandate smart decisions. Making a decision that turns out to be wrong, IMO wouldn't be good law.

Scot Peterson (Parkland, FL) is more who I was thinking as to deliberate indifference. Codify that and I think the element(s) can be made to be clear, one way or another.

I'm not defending the guy. He has to live with his decisions that day for the rest of his life.

I'm just pointing out that case law has been very consistent on this, and the jury agreed with that. That's why it was a waste of time and money.

Misapplying a law bc it feels good is not an effective system of justice.


An effective system of justice would ensure he lived with that decision every day for the rest of his life in a cage.


Cowardice is not a crime, or else we would have to lock up half the public for standing around and watching whilst people are victimized.

Bolded portion is correct, but a wholly irrelevant response to my description of how the world ought to be.
