Pretty fascinating listening to the various justices questioning the attorneys. I do find it ironic that the Justice that could not define "woman" is asking the questions she is in the transgender athletes case.

I have learned by listening that SCOTUS is a high-level fallating of justices by the solicitors and really all this could be hashed out in a smoky boardroom by 6 gents as it used to be. Ties solved by duel or remand to lower courts.

I am disappointed in Kagan, though. Really thought she was smarter than that.

Sotomayor thinks it's her job to dictate policy rather than decide legal arguments. She's an over-emotional hack in a black robe screaming at the sky.

Jackson is just an abject moron and I'm not even sure she knows all the days of the week.

I don't think a whole lot of Justice Jackson's jurisprudence, but the "I don't understand" thing is probably overblown. It's a rhetorical crutch she uses to frame her questioning and arguments. I expect that other Justices have similar tics, and I expect we all have our own in our communications.

Years ago (okay, decades ago), when I was practicing for a moot court argument, I got dinged by one of the practice judges because I was starting all of my responses to questioning with "Respectfully, Your Honor…". I didn't even realize I was doing it until it was pointed out.

Sadly, the empty robes are the loudest. I've had recent experience with that.

My first debate coach in HS had either a poster or wooden desk item with the saying, "those that think they know everything are very annoying to those of us who actually do." Obviously, arrogant and then some, but there's a hint of truth in that in some cases. The buffoons that really do think they're the smartest (and are nowhere near that) don't realize they're being laughed at by the rest of us.

Worked with a cowboy crew in south Texas for many years on a large ranch. One year they were working San Antonio Livestock Show / Rodeo and hit the Denny's at Loop 410. One of the cowboys was hooking up in the back of the restaurant around 2am when the other waitress alerted the rest of the crew to the 'big reveal'. Legendary outcome. KBJ has really elevated the entertainment quotient of SCOTUS oral arguments though levels no one could have expected. It's now just expected mass-market hilarity, especially when her pet issues are in front of the court. I think that is her only real value, expanding the portion of Americans who listen to at least the highlights (lowlights) of her drivel.

PJ Media has the main lowlights from yesterday:

Hashim Moopan, representing the Department of Justice, then had to give her a lesson that no Supreme Court justice should need: "Right. So, making exceptions is tailoring your law. That's literally what it means to tailor a law."
