Pretty fascinating listening to the various justices questioning the attorneys. I do find it ironic that the Justice that could not define "woman" is asking the questions she is in the transgender athletes case.

The most TimWalzed justice is also the one that talks the absolute most. Several orders of magnitude more than some.

The lawyer must have said "with all due respect" a dozen times trying to pull her back to reality. She kept hammering her infinitely small possibility point.

Kagan is smart, she's just an idealologue.
Sotomayor thinks it's her job to dictate policy rather than decide legal arguments. She's an over-emotional hack in a black robe screaming at the sky.
Jackson is just an abject moron and I'm not even sure she knows all the days of the week.

To mix metaphors, she gets tunnel vision and is like a dog with a bone with her thinking and really doesn't even listen to the answers she's so focused on her bizarre and often irrelevant point.
I am disappointed in Kagan, though. Really thought she was smarter than that.
🚨 HOLY SMOKES. SCOTUS Justice Sam Alito asks ACLU lawyer "what is a man and a woman?" and they DON'T HAVE A DEFINITION.
— Eric Daugherty (@EricLDaugh) January 13, 2026
Alito's response is perfect.
ALITO: What does it mean to be a man or woman?
ACLU: We do not have a definition for the Court.
ALITO: How can a court… pic.twitter.com/E5C9zX35NN

Just wait until the Commies take over this country and see who they put in charge. Will make the recently-incarcerated Venezuelan bus driver seem like a nuclear physicist.

Sadly, the empty robes are the loudest. I've had recent experience with that.
My first debate coach in HS had either a poster or wooden desk item with the saying, "those that think they know everything are very annoying to those of us who actually do." Obviously, arrogant and then some, but there's a hint of truth in that in some cases. The buffoons that really do think they're the smartest (and are nowhere near that) don't realize they're being laughed at by the rest of us.

Psycho, I was at A&M in the late 70s. Had a male friend who was an absolute horn dog. He loved going to New Orleans to jusy pick up drunk women on Bourbon Street. There was one time I knew he had been in NOLA but was very quiet in class for the next several days. Knew something was going on so took him out for drinks to ask WTH is wrong? What happened?
He was so visibly uncomfortable, "hey it's me. I'm your friend, no judgement. I'm worried if you are okay."
He finally told me about this chick he had picked up partying in NOLA and took back to his hotel room. He did notice the hotel employees kind of snicker but was too drunk to take the clue. Yep! After the BJ came the "big reveal."
I am sorry to say I burst out laughing. And I couldn't stop.

Worked with a cowboy crew in south Texas for many years on a large ranch. One year they were working San Antonio Livestock Show / Rodeo and hit the Denny's at Loop 410. One of the cowboys was hooking up in the back of the restaurant around 2am when the other waitress alerted the rest of the crew to the 'big reveal'. Legendary outcome. This one's for you- Fortenberry!

I have learned by listening that SCOTUS is a high-level fallating of justices by the solicitors and really all this could be hashed out in a smoky boardroom by 6 gents as it used to be. Ties solved by duel or remand to lower courts.
Quote:
She fumbled on: "So you're not treating the class the same, and you're not…. Uh, how do you respond to that? In other words, the as-applied challenge essentially redefines the class, or one could think of it as that. And so, what's wrong with that, number one, and how do you square that with our, uh, holdings in Caban, uh, which Laher later described in this way? In other words, Laher suggested that Caban was establishing that as-applied challenges of this nature do exist."
The argument was a dizzying tangle of "uhs" and qualifying phrases, leaving Idaho Solicitor General Alan Hurst unable to understand what she was even asking.
That makes all of us.
Perhaps worst of all, Justice Ketanji Brown Jackson expressed confusion about the requirement that state laws be narrowly crafted: "I guess I'm still struggling to understand why the state would have to have perfectly tailored laws." She continued, "I I I would think the state would just have to make exceptions where people can demonstrate that the justification that makes the state's conduct constitutional doesdoesn't apply to them."
Hashim Moopan, representing the Department of Justice, then had to give her a lesson that no Supreme Court justice should need: "Right. So, making exceptions is tailoring your law. That's literally what it means to tailor a law."
And this, ladies and gentlemen, is how you derail a SCOTUS thread...aggiehawg said:Psycho Bunny said:
