In Arkansas, Aaron Spencer defeated the county sheriff in the Republican primary.

He is waiting trial for the "murder" of 67 year old Michael Foster who had taken his 13 year old daughter. The county sheriff he defeated was the one who arrested him for murder. Michael Foster was free on bond for charges of previously molesting Foster's 13 year old daughter.

Barbara Elmore was reportedly doing everything she could to keep the public out of the trial. She had already had her gag order over the defendant last year. She wanted to limit the total attendance at the trial to be limited to 55 people including all parties, news media, and the public.

Also, she disallowed the the defense from filing at least some motions in confidence. Considering that there were undoubtedly documents about the so-called victim's abuse of his 13 year old daughter, it seems quite reasonable to file such motions in confidence.

Winning the Republican primary for sheriff in a heavily Republican county seems to me to be a good indication that Foster will likely be acquitted in the trial.

Fosler was no stranger to the Spencers. The Lonoke County prosecutors handled the case, with it landing on the desk of Circuit Judge Barbara Elmore. It's a little unclear who dropped the ballLonoke County, Judge Elmore, or some combination of bothbut what we know for sure is that this dangerous abuser of children was released from custody on a $5,000 bond, with a no contact order in place to prevent further abuse of Spencer's daughter. Then Oct. 8 came, and neither the bond nor the no contact order were worth the paper they were printed on.

Spencer's actions in that moment were nothing short of heroic. He ran Fosler's truck off the road, and firearm in hand, ordered him to release his daughter. Instead, Fosler fought back, and the struggle ended with Spencer emptying his firearm into Fosler. Spencer then rescued his daughter from the truck and called 911.

... But because local elected prosecutors and judges failed him, that was the position he was put in. Astonishingly, the prosecuting attorney not only failed to take any responsibility for what had transpired; he charged Aaron Spencer with second-degree murder. And wouldn't you know it, the judge on the case was none other than Circuit Judge Barbara Elmore.

Judge Elmore immediately took action to hide this affair from the public eye, dropping a gag order on everyone in any way connected with the case, preventing them, on penalty of contempt of court, from speaking with the press or the public about the case. Gag orders are not that unusual, but this gag order was so expansive and so obtrusive that the Arkansas Supreme Court stepped in and declared it unconstitutional, finding that it "was on its face a plain, manifest, clear, and gross abuse of discretion and in excess of its authority."

Judge Elmore was undeterred. Despite the constitutional right every defendant has to a public trial, she essentially closed the trial to the public, greatly limiting the seats available to the public, media, and even Spencer's own defense team. Elmore did this without providing any alternative means of viewing the trial, and without any evidentiary hearing or judicial findings justifying it. For the people of Arkansas, it seemed like the fix was in. The judge who had once failed Aaron Spencer's daughter was now committed to ensuring that his trial would happen in as close to secrecy as she could muster.

Statements from the prosecutors in this case are not only embarrassing; they should trouble the people of Arkansas. Prosecutors suggested that Spencer's angry comments from Julywhen he discovered that his daughter had been raped by Foslerwere somehow evidence of his intent in October. Never mind that such anger would be the natural reaction of any father. And never mind that Spencer didn't hunt down Fosler and murder him in the weeks or even months that followed; he shot him while rescuing his daughter from another kidnapping by Fosler.

Prosecutors also suggested that Spencer should have just called 911 when he saw his daughter in the truck with Fosler. That a father should give up the pursuit of his daughter's kidnapper and rapist in the hopes that the police could arrive in time to save her is so astonishingly absurd it boggles the mind that any prosecutor charged with protecting and defending citizens and victims of crimes would countenance it.


The prosecution and the judge are sick and evil.

Prosecution and the Judge are no better than the dead pedophile, except that they haven't received their just compensation.

They both deserve the penalty they'd get if Spencer is convicted. They know they F'd up and have bent over backwards to hide their original F-up by turning him into the bad guy.

This to me is up there with the people that fake racism. They should receive the punishment a person would receive for committing the fake crime.

While there is still a trial, I have no idea! But this is from Facebook page pre-trial hearing this morning.

Big win for the defense in today's pretrial hearing. The judge ruled in favor of Spencer's case, expanding victim character evidence beyond Lonoke County. This allows a more complete picture to be presented and is a clear setback for the prosecution.

The judge also granted reconsideration on the expert witness issue, showing that key rulings are still in play and the fight is far from over.

On the missing evidence, the court is not letting the State off easy. The defense now has the opportunity to pursue a spoliation argument or seek full dismissal, putting significant pressure on the prosecution's position.

The prosecution's narrative is under pressure, and Spencer's case continues to gain ground.

Couple of questions... First and foremost, the guy was protecting his daughter and a pedo is dead. I don't see the problem.

1. Is anyone saying there was an issue with the soon-to-be former Sherriff? Sherriff can't keep the pedo rapist & kidnapper in jail.
2. How on earth did the pedo get the daughter into a truck AGAIN? Is there some Stockholm going on? Something more? Doesn't matter, she's underage and cannot consent, but I still have questions.

She was 13 and being abused by a 67 year old. I assume there are massive mental implications on her. He likely groomed her significantly.

It's rape and abuse even if she thinks it's consent, becuase a 13 year old isn't mature enough to consent. My guess would be she got in the truck willingly. She might have even snuck out specifically to go to him.

None of this changes my belief the dad should be rewarded.

yah, I was wondering how he was able to kidnap her in the middle of the night without a sound.

That's not accurate - the rules for pardons are super undefined.

What is defined is that he can only pardon from federal crimes. This defendant will likely need a pardon from the governor as well.

Welcome to a system that is overrun by progressive liberal judges and DA's that think they are above any laws and can pick and choose which laws they will enforce and to what degree they will enforce them.

Tarring and feathering needs to make a comeback. Public officials should understand they are beholden to the people, not themselves or what they perceive as a tier above the electorate.
