Correct. Presidential pardon wouldn't protect him from civil liability for crimes in Texas/Florida. Some elder care/advocacy groups might use discovery in this case to go after him, I would hope.

Keep an eye on Peter Daszak being the involved case that is under seal, as a co-conspirator in NY. Thread:

If it's for anything he did as a federal official it will just get moved to federal court and then tossed because of the pardon and supremacy clause. Same reason Minnesota will never be able go after ICE agents.

I generally mentioned some of this (not directly related to Fauci) last week in a thread I started following the SPLC indictments.

Before Trump's hand was off the Bible during his inauguration folks have been clamouring for him to start making arrests.

Investigations are NOT quick. He had to get rid of the partisans and the rats, them get solid and sound investigations under way.

I pontificated if the SPLC indictments were the start of more. The replies were the expected typical F16 defeatest tropes. Well... A week later and another big indictment is handed down. You/me, the general public, will know what's being done after it's done. We have no need to know what's still in the works.

The first question I have is why the NIH terminated the grant. It reads like they did it because the PI/scientist speculated that the virus came from the lab.

It's not easy to get people with crimes for doing great hatm with bad policy or regulation because they can always claim error or being badly informed. You have to find an actual statutory violation AND have evidence that the violation was purposeful in most cases. It's not easy to find a law that these bureaucrats violated and the evidence to prove it to being an effective criminal charge that will survive trial.

Presidential pardons only cover criminal prosecution, not civil liability. But, the case would almost surely be removed to Federal court if filed in state court.

Filing the case in federal court in Tyler, or Marshall, TX, would be just fine, IMO.

Dr. Fauci is not going to be prosecuted because of the pardon from then-President Biden.


HOWEVER, legal action can name him as an unindicted co-conspirator. The pardon would not protect him from this action, and such an action could lead to SIGNIFICANT civil liability for him and his family.
