Elderly man pushed down the stairs going into a subway station. Bad guy had been arrested approximately 5 times since February. Once for assaulting a LEO and and another for assaulting a woman on the subway.

For assault on the LEO he was released on "non monetary" bond. On the assault on the obviously white woman on the subway, she refused to cooperate.

" The woman chose not to cooperate with prosecutors. She told the New York Post she did not want to put another Black man in jail. She now says she regrets it entirely."

And I am sure she suffers from TDS. A criminal is a ciminal, regardless of skin color. Pretty easy concept.

Is there any precedent of a victim of a crime being sued in civil court for negligence in not pursuing charges against someone that undoubtedly performed an illegal act against them, but then the same criminal harming someone else similarly later?

Would put an end to the "I didnt want to put another XYZ in jail" depsite the obvious guilt.

An obvious criminal committing another crime seems like an obvious risk of not pursuing charges.

In her grandiose effort to virtue-signal about how un-racist she is...she made a very ignorant and ironic decision...based solely on race.

She should be all for putting criminals in jail...regardless of color.

But I guess the criminal's life was worth more than the poor old man, whom her decisions indirectly killed.

You don't want to set that precedent. Lawyers and the government would have a field day with picking winners and losers.

No. Not even police officers are obligated to help or assist.


100% understand that.

It would be interesting to have the latest victim sue the lady in civil court, and then have the jury listen to her say, "yes I knew who assaulted me", "yes the police told me he had a history"...then why did you choose not to press charges, "well because he was black"

Did it occur to you since he assaulted you and others in the past it past that he may assault others in the future since you elected not to pursue charges because "he was black"?.....

Some juries may not find that reasonable.

Why must you be so racist? Don't you realize it's the fault of our racist laws and racist social constructs? How can someone take responsibility for their crimes when no crime can ever be their fault due to racism? If we don't allow law abiders to just accept that they might be mugged, raped, maimed, or murdered but it's ok- it's not the perp's fault - then we can never get rid of racism.

Taylor Sheridan basically calls this out on the first episode of The Madison when the blond daughter gets knocked out and robbed and is scared to tell the cops that it was a black dude that did it.

Sadly, almost half the people in this country fully support this approach to crime and the prosecution of crime.

What these idiots do not understand is that this mindset actually incourages crime by telling people of a certain race that they will very likely not be prosecuted no matter what they do.

Liberals are always the ones to bring race into it. He was a bad guy a criminal. His race should not have mattered, but she was virtue signaling and now she basically helped him kill another person.

The Regret: The woman told the New York Post, "I regret it 100% and I actually feel really bad that a man lost his life". She added, "Maybe a part of me was just like, I don't want to put another black man in jail, but, you know, at some point, if you are a criminal, you're a criminal, and he was scary, he was a scary guy".

Putting sociopaths in jail actually helps potential victims AND the criminal too. The criminal csnt be adding to his or her record if they are in prison, and some do age out of being a sociopath eventually.

Doesn't really matter. Would not be an intentional tort against the man attacked (or his estate) nor would that satisfy all of the elements for negligence, IMO. Particularly, duty owed, breach of that duty and proximate cause.
