Well, TBF, packing the SCOTUS can be done legislatively by amending the Judiciary Act. SCOTUS cannot be abolished since it is specifically mentioned within the Constitution but no number of justices is specified. And the number of justices have varied over time.
But here's the thing. Even if the dems were to win the Senate and the WH, they STILL wouldn't have the 60 requisite votes to pack SCOTUS. The only way her "'plan" would work would be to immediately eliminate the filibuster in order to pack the court.
She's telegraphing what the Dems will do once they get to power. The MINUTE they have the Senate at 50/50 or better, the House and the Presidency, you can bet your last dollar that the fillibuster WILL be gone.
So if the above statement is correct, the fillibuster is dead - the question is only when it dies. That is why I am amazed that Mitch, Tillis, Murkowski, & Collins won't vote to kill it in order to protect the election process... ie. the Save America Act.
They're going to have us all die on the hill of "protecting the fillibuster", and the dems will use a faulty election process to gain power and immediately kill it anyway. And then follow that by doing all of these "no bad ideas" to cement their power position.
