The 10k selling thing came in later as a way to split up the collection into 10k chunks and keep it in small claims court.

Not sure of the legality of both actions... Im not a lawyer but I feel BAM/Bricks n figs could have challenged the validity of it, had they taken it to the judge... but going to court probably opens up a lot of other issues.

Exactly. But my point is - if those sale contracts were real then the old guy no longer really owns the legos (but may still be owed money from Ben and his friends as I seem to recall some borrowing of money going on as well).

These guys really stepped into the deep end on this one.

Maybe this is answered later, but that seems like an odd move.

Why not just call an attorney, and handle it with the courts from the very beginning? I feel like that would have been my first call, after he found out the franchise owner was booted.

they don't have the money to go against a multi-millions dollar corporation. they corporate leaders even mocked and threatened them with just that. they would ruin them financially in court if they tried to go that route.

they don't have the money or the time. It would be a long expensive process due to the fact they would probably have to sue the former owners (who no longer live in the country) who would in turn have to sue B&M. It would be years before they see a dime.

Going this route, whether you agree with the antics or not, is a lot quicker.

To piggy back, I believe he said he talked to attorneys and was told 60-70k to get going due to the complexity of the case.

Apparently all the small claims cases were actually dismissed and he didn't receive default judgements.

The corporate office seems to have gotten some good advice for once and are running some good PR.

(my paraphrasing)

They are saying their investigation showed the prior franchisee kept three different sets of books and there's a lot of difficulty even doing the forensic accounting. They don't know what was sold and when.

They are saying they were never informed of the consignment deal and it seems to have been a side deal made by the prior franchise owner without corporate approval. Apparently their process for consignments include someone from the corporate office meeting with the owner and verification of insurance on the collection but these never happened.

They are also claiming the value of the collection was vastly overstated.

However, they are stating they would pay the owner back for the value of the collection and allow him to have whatever Star Wars merchandise remains in the store regardless of whether they can prove it belonged to the owner or not. The records are so bad they don't know what's his and what isn't.

When the prior franchisee sold it to the new franchisee they are alleging shenanigans on the part of the old owner.

They have now dumped the new franchisees and are closing the store.

the problem with all of that is they've been caught on tape lying over and over. It was also videoed that there was a consignment that was still in effect. Will be interested to see if the 3 sets of books holds up the scrutiny or if it is another fraud on their behalf.

The corporate office is saying a consignment deal was made on the side by a franchise owner who didn't follow corporate policy and didn't keep accurate records. They aren't denying a consignment deal was made but are continuing to assert the loss is not their fault.

They are really throwing the prior franchise owner under the bus and it's possible they are doing so for good reason.

Their PR strategy thus far has been nightmarish but at least now they're presenting some sort of reasonable counter-narrative. The scorched earth tactics against YouTuber are not the right way to go in the era of social media. You put out a blanket statement acknowledging the controversy and vow to get to the bottom of it. Stifling speech about the controversy only makes it blow up more.

This is a load of bull**** and 100% them trying to save face... anyone that believes it obviously didnt watch the videos very closely.

They havent tried to work with Mansell at all, they trespassed him almost immediately and had told him it was a civil matter and he would need to sue them. Both the new franchisee and corporate placed blame and did everything they could to avoid helping the situation.

My expectation is the Mormon church will force them to fix this mess as quickly and quietly as possible.

I saw that but havent seen any of the clips yet (waiting for a good collection/summary... have a link?)

Was this release done for a foia request? Or something the PD planned to do but botched?

I'm curious if the "accident" was someone internally wanting to do right.... or perhaps a hacker that did it since this has gone viral. Great timing either way.
