Maybe (that's very much in dispute), but then the government went Leeroy Jenkins against him and everything was dismissed.

It's my understanding that he simply burned files to CD-ROM and labeled them as music CDs to exfiltrate them from the SCIF where he was working in the CENTCOM AO. I believe the government went after Assange for publishing stolen classified information and prosecuted Manning for felony violations of 18 U.S.C. 798 unauthorized disclosure and 8 U.S.C. 793 Espionage Act.

Could this be a leak of "official recordings" versus someone in the room who clandestinely recorded when they should not have? By some bureaucrat incel whose job it was to save the recordings on the secure drive and respect the responsibility they swore an oath too?

If the leak relates to national security, then I think it's time to teach the authors a lesson and execute them on the spot. At some point, we need to get serious about national security.

I think they are walking a fine line here and as we know SCOTUS rulings are not settled science.

Freedoms of the press was intended for protection of co-conspirators who leak classified information in an attempt to subvert the duly elected POTUS. HTH.

If someone knowingly receives stolen merchandise, they can be punished for it.


The information that the journalists are receiving has been stolen from the US government and the journalists know that it has been stolen.

I understand the First Amendment issue, but as has been shown, it has limits. This should be one of those limits.

Geez that was a long time ago. I know the charges were dismissed for some fruit of the poisonous tree type of evidence collection, IIRC. But a couple of years later, the same Nixon guys who committed the Watergate burglary had also been involved in the Ellsberg case. Nixon used the worst guys possible, LOL.

First amendment protection for the publication IF they were not complicit in the breach, that is. If they only found out after the fact when they were being given the materials, still can publish it.
