I was at a gun show today in galveston looking for a silencer. With whatever law changers there have been I was hopeful someone had stuff to see and maybe buy.

One booth was selling silencers that, they claim, are legal thanks to a texas law passed recently. And as long as I don't take it into another state it's legal here. No stamp, no tax, no ATF application. Anyone know about this?

I'll dig up the law and post in a minute.

Yeah, still illegal federally. Just like Marijuana is illegal federally.

All it takes is someone at the Fed level deciding to make a point or example and your life could change.

I support the concept, but wouldn't want to be the person at jeopardy to test the concept in court!

This sounds like a good analogy. What enforcement actions is the ATF capable of? Do they patrol gun ranges?

This should be rich.

Ask him for court precedent. Ask him how he is ensuring the raw materials and machinery used in manufacture didn't cross state lines. Ask what his badge number is.

There was a lawsuit filed in federal court that was dismissed for lack of standing. Of course if you were to buy from this guy and get crossways with the ATF then you would have a legit case and could be the test case for this law….
I like the idea behind the law, but in my non lawyer opinion it doesn't have a chance in hell of standing up to judicial scrutiny.

I wonder if this group is setting themselves up to be the test case. No website or anything other than a recently made Instagram page. Note this is not the same as Silencio Suppressor Systems based out of the Dallas area. These guys are from New Braunfels.

Feels very sovereign citizenish.

They're setting up random people that are unfamiliar with the law to be the test cases. This is really sleazy thing to do without full disclosure.
