Our new neighbor decided to unilaterally modify our downsprouts (inside our property) while we were away because they dont like the fact water flows towards their property. We removed the hose they added and they put another one in while everyone was at work. Previous neighbor covered the material costs of a french drain and I maintained/installed it.

Not sure talking to them will be productive (still will try) since they don't seem to understand the concept of property rights so just getting everything crossed and dotted.

I was on a jury where the downstream party sued the upstream party for damages from rain runoff. We found the upstream party innocent. This was in Montgomery County.

Most subdivisions are graded to have the drainage run to the street between the houses. If one side builds up their yard with compost or sand, it can shift the drainage to the neighbors property unintentionally. Unless the neighbor can prove the drainage was directed at their property maliciously or with intent to cause damage, they are SOL.

But the correct answer is to burn his fence down and bang his wife.

A) Put up trail cameras to capture video of neighbor trespassing and installing unapproved hoses on your property without permission.

B) Set up motion activated sprinklers in the area, all directed at the downspouts.

C) Post videos.

It is always worth having the high point in the neighborhood.

Runoff is going to be less of a problem, but there is a more important issue. If someone's sewage backs up and starts flooding their house, it will be more likely to be someone other than you.

When we put in a pool I solved our backyard drainage with 2 Schedule 40 4 inch pvc pipes side by side. One is connected to the roof downspouts only and the other to the French drains. Both go from the back yard to the street in front. Has worked great. The original French drain cheap pipes had been broken in numerous places by tree roots and projects around the yard.

If we win, just write the score in their lawn with winter rye seed. It will come up in a few weeks and give them a good reminder.

This doesn't feel like lawyer type of stuff. Seems an expensive route to go, and then win or lose, you still have to live next to the dude. I'd just see if it's possible to talk to him and see if there is an amicable solution. If I were in this situation, and whatever the neighbor did to my gutters resulted in what he considered an acceptable solution, then it seems the issue is in fact something i can solve and should....and maybe we could work out a you pay/I do kind of thing. I just can't work out a situation that a court could come up with that would be worth fighting with.

That has to be cheaper and less hassle than an attorney.

Gotta agree. Getting legal doesn't always work out how it should or how you expect. And it's expensive and stressful.

Neighbors are awesome. We had a little neighbor drama when we recently purchased a home. Stay calm and let them continue to look unreasonable - document it all.

No trespass signs at the property stakes on the line, cameras to document and let the sheriff do the work for you if necessary.

Jason_Roofer nailed it - be the reasonable party. Offer solutions.l - it's up to them to work with you or not.

I would be cordial/respectful and speak with them first and see whats going on...and at the end of the conversation I would tell him it would be in his best interest never to touch my property again (while making direct eye contact).

OK, so I have to say I'd be pissed off if someone started adding things to my gutters without permision. That would make me mad and probably have me thinking about how I can get them back. Which is not usually the best way to handle things. Though I understand the feeling and thought process. I try and work with my neighbors even if I don't agree with them. There has got to be a compromise.

The compromise advice is great and all but the neighbor has already trespassed TWICE and manipulated the OPs property openly, blatantly, and apparently with no regard or concern for the consequences.

Trying to deal with people like that is usually futile and often times can escalate into dangerous situations quickly.
