I would welcome any US or Mexico-based legal referrals for a situation my boss's husband got into over the weekend. He's a naturalized AMCIT of Mexican heritage and he was returning from a weekend trip to visit family in Coahuila. Bottom line, he forgot his Texas car registration, Guardia Nacional did a search of the vehicle, and found loose ammunition in the trunk from a recent shooting range trip. He's been charged with federal crimes ranging from 5-20 years and is in custody in Ciudad Acuña.

Do you any of you all know someone (esp maybe the Coahuila governor?) that could assist quickly with this situation?

I would look for Jeff/and or Scott Schmidt in Corpus. I know at one time they had connections to lawyers in Old Mexico, I believe it was real estate related but it would be a start. They are both Aggies and great people.

I heard a similar situation happening with hunters inUS crossing and getting caught. Pretty sure they were able to bond out or something and got across to US. Wrote the truck off as a loss.

A local in my area just went through this, but I believe he had a handgun and made a wrong turn into a crossing. He was in Mexican prison for at least a year and his family was being extorted for protection money on a weekly basis. Just got back in the last couple of months.

Yeah we had a local gal get caught with a handgun, it took 8-10 months to get her out of jail and had to pay to keep her fed in jail. Not a good situation.

The company my dad worked for had an employee traveling in Mexico and got into a car wreck that killed a local. The ceo of the company with general counsel had to travel to Mexico with a briefcase of cash and bribe everyone but the dog catcher to get her out. Thats how it works down there.

It's really a beautiful country. Just have to play by their rules and not do anything stupid. Guilty until proven innocent down there.

You're right, but it scares me to think a small minor mistake could put in jail for a year.

I've spent some time there and had a few incidents that could've been bad...and I wasn't trying to do anything wrong. Once we were set up by a local, and had to bribe the cops. Had another guy try to sell me drugs by putting a baggie in my hand...as soon as I realized what it was I dropped it and booked it outta the store (for fear of being set up again).

Sometimes just trying to follow the rules isn't enough in 3rd world countries...

This is the rule of law way to go, but expect a long jail stay, with ultimate return eventually.

To make it shorter you need bags of cash and a fixer with local knowledge

Yea I'm thinking that there's a chance that local police could be "convinced" for a fee, to release them and run to the border. As far as ever crossing again to visit relatives, I'd forget that option maybe even burning my passport.

Listen to the Joe Rogan episode with UFC fighter Daniel Rodriguez. He went to Mexico and was caught with an oz of Marijuana. He spent 8 months in jail there. It's an interesting story in how he got out and goes into the legal process.

He needs to get a good Mexican attorney, DONT SIGN ANYTHING, call us consulate.

He's commited an FGR crime - federal

Amparo filing will be hard since it was a valid search at the border due to lack of papers. Thats usually where you get off here but depending on how long they keep him in jail it can be used for his release in the future. If the sentence carried by the crime is 2 years or less they have 2 months if it's more than 2 years they have 6 months to bring you to trial. That isn't usually followed because of case load, so getting a good Mexican attorney that know the system is crucial.

When did this happen? Has it been more then 48-96 hours? If so, what did the judge say at arraigo?

Weapons at the border fall under the Ley Federal de Armas de Fuego y Explosivos which usally doesn't provide bail.

I've known two people that went through this. Both eventually got out through a lot of headache and both forfeited the truck. I hope this situation is better but that seems to be the norm.

There are a few mistakes that are this costly in Mexico, but this is one of them and it has been long before we heard the phrase 'cartel violence'. I remember stories of spent 22LR brass that collects under seats or in cab corners of squarebody trucks resulting in some pretty hairy situations for neighbors many years ago. Mex has always been strict on guns and ammo - to include spent brass.

Mexico usually has a very efficient Judicial System .The arresting officers can circumvent lenghty process by acting as the jury and judge . They then can collect the fine they impose and release the subject as soon as the suspects wallet is sufficienly thinned.

fastest way is to buy your way out if they have the money. otherwise, its a waiting game unfortunately.

I may or may not know a guy that got caught up and family flew a brief case full of cash down and brought him home.

Thats a rough one.

The Old Man always said that if you get caught in Mexico, do not act like you have money. As far as they are concerned you are an unemployed orphan.

If they find out you have money/connections they will extort for it.

Then, its either going to take money, or Triple Canopy.

A cesspool run by cartels and corrupt government officials (though in some cases they may be one and the same). We should round up all the illegals and make them dig a moat between the two countries. Deep, wide, and full of bad things.

I used to work for Wells Fargo...put in a PTO request outlining that I was going to Mexico on a bass fishing trip in the mountains above Mazatlan. Got a call a couple hours later from one of the Corp HR folks telling me in no uncertain terms that if something happened to me down there, they were not going to help.

Makes you think.

Most of their citizenry ignores the rules but they throw the book at visitors. Corruption at its finest.

Only had to outline it if you were leaving the country. This was a long time ago, but I think it was just to certain countries.

Either way, dang sure made you think about your choice.

Fishing was great though...had armed protection the whole time.....although we assumed that they were with us by day and then with the Cartel by night. Whole long story to all of that. If you have ever fished Comadero with Ron Speed, you know the drill!

GulpJuiceFingers is well versed with this exact scenario in Acuña. Let me see if I can get any recs from him. He was outta there in a few hours and had enough .22 ammo to kill an army of rabbits.
