Any thoughts on the Bryan City Council candidates?

What about the proposed stock laws? I would have thought Brazos County already required livestock to be fenced in, but I guess not.

I'm in College Station, so no opinion on Bryan City Council.

I voted For both propositions. Apparently, current law is that livestock can roam fee in Brazos County unless voters pass a ban. A Wixon Valley man gathered enough signatures to get these on this year's ballot.

Any rancher with livestock works to fence their livestock in. This is a poorly thought effort that won't do anything other than make it harder for ranchers in the county to do what they already do. Vote no. Yes vote will make the work of the deputies and the rancher harder, not easier. Without a specific law, Texas law is a fence OUT state, not fence in. However- ranchers want to fence in, and do so. The proposition is unnecessary.

So what you are saying is that I as a landowner should he required to keep up my fences to keep other folks livestock out. Nope. You have livestock you should be required to keep them in. Voted yes.
ETA: how will it make ranchers lives harder if they are already keeping livestock fenced in as you say? All it would do is hold them responsible for what you claim they already do.

Vote yes on the livestock laws. My neighbor kept letting his cows get on my property. I would have helped him fix the fences but his method was to just ignore me. Only one problem, the front of my property isnt completely fenced and they found their way out grazing in the medians of hwy 6.

I wasn't around for the rodeo but Im sure they had to shut down traffic both ways and thankfully no one was hurt.

Information from a rancher in Brazos County

Folks,
Please vote Against Propositions A and B
On the Brazos County Ballot this election. It will criminalize the farmer and ranchers of Brazos County. If you want to know why, you can read further.

A friend sent a copy of a sample ballot for the current elections yesterday. They were asking specifically about the Brazos County Special election on Proposition A and Proposition B. Currently Brazos County has free range status like most of the rest of the state. So, if a cow or horse is loose on the road and someone hits it, the livestock owner cannot be sued unless it is proven they are negligent and knew that the livestock was out but did nothing. So, these 2 propositions on the ballot seem to make good common sense. However, what will happen is that anytime a person runs through a fence in the middle of the night in their car, (and this happens at our place about 6 times a year on average) and then leaves without any notification, (which is 90% of the time) to us or law enforcement and a cow or horse get out on the road and is hit by another driver then the livestock owner under this new stock law, if it passes will be liable even though they were unaware the fence was down or the animal was out.

It's more that there are a lot of vehicles that run thru people's fences, leading to the occasional livestock vs. vehicle collision.

When I was a volunteer in South Brazos County, there were many times that we were attempting to call landowners in the middle of the night due to a drunk driver leaving the road.

Happened to me last week. Someone cut my fence to get part of their vehicle out middle of the night. Had a hole in fence I knew nothing about till our friends at the SD let me know. Fixed it next day.

I have a friend who totaled her car last month when she hit a cow in the dead of night (suburban no less). Thankfully, nobody was hurt.

Those propositions aren't going to a change a thing. They are just an attempt by the county to get money out of ranchers.

Ranchers don't want their livestock out roaming around. They are expensive and if they get injured or killed, they are out a lot of money. They also don't want anyone else getting in an auto collision with them and a person getting injured or killed
When they are out, it's an accident and they take care of it as soon as they can.

If these propositions pass, it won't change the number of livestock getting out of a hole in the fence. That just happens. It's just going to cost ranchers money.

I find it interesting that some of the same people talking about wanting this to pass are ok when it's the county making a money grab on ranchers.

But paid parking on the street in the city? That money grab is evil

here is pretty good legal description of open and closed range. Going closed range puts a little more responsibility on the livestock owner to keep their stock fenced "in". also have a closed range county (it could even be part of a county) gives the landowner where cows aren't supposed to be a little more leverage in removing them. at least in my opinion as a internet lawyer

The majority of ranchers will do everything that they can to keep their livestock penned. It's stupid not to. This will do NOTHING to stop accidental escapes by livestock. Not a single thing.

This is placing unneeded laws on the majority because of the actions of a few.

Tell me....what is "conservative" about that?

Does anyone have the full text of the propositions (not what is on the ballot)? I have not been able to find them, and not knowing the details, it is impossible to make an informed decision.

I agree, however it just takes one or two irresponsible ranchers to foul things up. Do we punish every rancher? I think not. Besides we need something to keep our lawyers occupied.

the problem is those that have derelict fences the County has nothing to reprimand them with. There is a place off Elmo Weedon where cattle were out all the time. The place has bad fence and hay string tying up the fence in places and the fence is too low compared to the roadway. The cattle is out all the time. I ran into the Livestock Deputy one day and asked him about it. He said not much he can do because of of the current no fences designation maybe if the next time it would be a $75 fine possibly. I said it is not only dangerous for drivers on this road especially where they get out at and then owner could also loose livestock. When I called in one day and said there are cattle out again and they said let us guess where.

This right here. Sheriff's Dept. has knocked on my door in the middle of the night for this very reason on more than one occasion. I live in Millican.

Multiple sources I've heard speak on the subject or seen on line list Brazos County's rules on the matter as "varying by precinct." What this does is make the rule(s) uniform across all of Brazos County instead of varying by precinct. I've NOT seen much communication from the people who put this on the ballot to make their case and offer the idea of UNIFORMITY for all county precincts to the voters.

At various agribusiness events over the years around the state the trial lawyers are always interested in making the total pool of deep pockets to go after larger after any unfortunate accident in these events (which potentially increases their take). This makes it eaiser for attorneys to collect from ranchers/insurers when the animals get out and get hit in the roadway by a motorist.

If you can't keep the cattle out of your pastures, fill your freezers!

Was this on 21 west of Caldwell? I had to detour because of car/cattle accident on the highway after getting back from the airport.
