On the Brazos County Ballot this election. It will criminalize the farmer and ranchers of Brazos County. If you want to know why, you can read further.

A friend sent a copy of a sample ballot for the current elections yesterday. They were asking specifically about the Brazos County Special election on Proposition A and Proposition B. Currently Brazos County has free range status like most of the rest of the state. So, if a cow or horse is loose on the road and someone hits it, the livestock owner cannot be sued unless it is proven they are negligent and knew that the livestock was out but did nothing. So, these 2 propositions on the ballot seem to make good common sense. However, what will happen is that anytime a person runs through a fence in the middle of the night in their car, (and this happens at our place about 6 times a year on average) and then leaves without any notification, (which is 90% of the time) to us or law enforcement and a cow or horse get out on the road and is hit by another driver then the livestock owner under this new stock law, if it passes will be liable even though they were unaware the fence was down or the animal was out.
Just what we need....more lawsuits. Sounds like an Against vote for me.

It happens enough. I've known several people who have hit both cows and horses. One hit a horse standing in the middle of the feeder road in south college station.

That's a drama filled (..criminalize ranchers and farmers), full of misinformation post.
Without negligence in play, the land and/or livestock owner is not going to be held liable, plus under current open range rules, State and Federal highways are exempt, meaning adjacent livestock owners are already responsible for keeping their livestock off the roads.

I thought with the free range law now, the lady that totaled her suburban could be sued by the cow's owner for killing his cow.

the little bit of reading i've done on it either way the law is doesn't stop anyone for suing the other party. It all depends on if you can prove intent or negligence in a court of law

A better solution would be more accountability such as criminal negligence and less tort relief. If a rancher won't fix a fence after several requests by the county they should be charged. If your cows get out because of someone else cutting your fence then you should be exempt. I voted no on this proposition. Fix it and I might reconsider.

BTW, Federal and state highways are closed range areas. If you hit a cow or horse on a SH feeder road there is a law n effect that puts the liability on the rancher.
Walk softly and carry a big stick! Make sure the big stick makes big boom noises and flashy bright lights.
