What was he cited for? Guessing PI or disorderly conduct? If so, he can rep himself and request jury trail. They will likely offer some easy short-term probation as trail date nears (like day before possibly). Doubt they want to summons jury pool for this type of deal unless he has a more serious charge.
If he were my son, I would refer back to my orginial reply. I would keep telling the prosecutor I will see you at trail until they offer 3-6 months' probation and no record of the arrest. No community service BS either. Wasting tax $$ going after a bar scuffle assuming no injuries to either party.
In order to not have any record of the arrest, it would need to be expunged. To an arrest expunged, you would need a lawyer…
Again, Reilly Garrett is an excellent choice. Has worked on both sides, law enforcement and defense attorney. He has an intimate understanding of both sides of the issue.
Not true. Arrest doesn't mean he has to have it expunged. Depending on what they work out like pre trial diversion, thrown out altogether or something he could file petition with district court for expungement or ask for order of non-disclosure to seal records.
It's a stupid bar fight. Certainly can higher an attorney but it should not be required in this situation based off of what we know.
OP… if he wants quick, easy higher someone. Either way update us on outcome. I'd bet this turns into a lot of nothing but a good story to tell down the road.
I'll rephrase, if it happened it College Station, which it probably did, it will typically not be removed from his record without expungement. Argue all you want. Facts are facts. They don't work out removing entire arrests from your record for pre-trial diversion with no community service around here.
