Pusch alleges that Nguyen broke the company's founding contract agreement and conspired to defraud the firm, among other allegations.

In a declaration filed in April, Pusch alleges that Nguyen failed to follow the memorandum of understanding that ended last summer's lawsuit. As part of the agreement, Nguyen promised to assign the "We Push, You Win" trademark to Pusch & Nguyen.
Pusch says that Nguyen has "failed to take any active steps to assign the registration, and it remains in his individual name and improperly under his sole control." A search of the United States Patent and Trademark Office's online system shows that "We Push, You Win" is still held solely by Nguyen. Additionally, Pusch alleges that Nguyen has created a new law firm, Chi Legal Group, bought property near Pusch & Nguyen's principal office, and attempted to register three trademarks that belong to Pusch & Nguyen: "LAW BROTHERS," "AVOCADO AT LAW," and "AVOCADOS AT LAW."
