Jones set out to change that. After he became chief judge in 2015, Jones enacted rules that assigned the biggest chapter 11 cases to either himself or Isgur, who had been his mentor in private practice.

Jones contacted Kirkland's top bankruptcy partners at the time, Jamie Sprayregen and Paul Basta. In December 2015, Sprayregen and Basta stopped by Jones's chambers in Houston to meet with the judge, people familiar with the meeting said. A Kirkland representative described it as a brief meet-and-greet.

The following year, low oil prices pushed many Texas oil drillers to insolvency, and Kirkland began filing large energy-related bankruptcies in Houston. Later, when Covid-19 lockdowns triggered a rash of corporate defaults, Kirkland filed cases there for department-store chains JCPenney and Neiman Marcus.

Kirkland brought in Jackson Walker as co-counsel for most of its Houston cases, including clients from out of state.

"Then I asked TruthFinder." He learned from property records on the Harris County website that Jones and Freeman had bought a home together in Houston in 2017 and still owned it.

The Fifth Circuit Court of Appeals was alerted and initiated an investigation against Jones. After a little more than a week, the court's chief judge said she found probable cause that Jones had committed misconduct regarding his intimate relationship with Freeman. Jones resigned days later.

A Kirkland representative said the firm and its lawyers didn't know Jones had a relationship with Freeman until it became public last October.

Following Jones's departure, a civil division of the Justice Department filed a series of motions challenging roughly $13 million in fees that Jackson Walker had billed and which were approved by Jones. That included more than $1 million billed by Freeman in 17 cases, court filings show. During the time Jones was approving Freeman's fees, she paid property taxes on the house they owned together.

The Justice Department said the bankruptcy system was "significantly compromised" by the Jones-Freeman relationship in at least 26 chapter 11 cases involving Jackson Walker. Kirkland was co-counsel in most of those cases.

This relationship was an open secret among the bankruptcy bar.

David Jones was integral in growing the sophistication of the bankruptcy bench in the Southern District to the point that it became a very favorable venue to file in. The bad part of this whole thing is that it has really hurt the number of cases now being filed in SDTX.

...once upon a time I worked for a pretty large but privately held GC that was doing hundreds of millions a year in public works/infrastructure projects. I was a project manager type who got in with the company because they donated a lot of money to Tom DeLay and I worked for DeLay from 2001-2003 but wanted to come home to Texas.

Anyway, the owner of the company was banging his secretary who paid for her tits on the corporate Amex among other things and concocted an embezzlement scheme where she and her friends she installed in AP created fake vendors and POs. And because she was putting that ***** on him (she was a pretty hot but whiskey-tango chick and the owner of the company was an extremely dorky & awkward engineer) he ignored it. Eventually the owner's wife got wind of it all and divorced him and to pay for the divorce, among some other business problems forced the company into bankruptcy.

Isgur was the judge and Freeman with Jackson Walker was one of the attorneys/firm representing my former employer through the process. They even retained me as a consultant to help value and sell off the assets and I even sold the various properties (offices, construction yard, and concrete plant) which was how I got into commercial real estate back in 2005.

SD Tex. Ch.11 lawyer here. It's been an open secret for a long time but the time to disclose was at least when she left the job as his clerk.

For many people involved, I think the situation is going to get a lot worse before it gets better. Think in terms of disgorgement of fees and indictments.

BK bar should be ok - the mega-cases weren't big generators of work for all that many locals.

Have had a few customers in BK in So Texas court. We as usually unsecured creditors with lien rights were always treated very very fairly. I also appreciated how fast Jones moved cases though the court. As opposed to say Delaware where the case will sit until the Trustee and experts pick every piece of rotting flesh off the carcass before they confirm the BK plan.
