100th Judicial District Judge Indicted on Charges of Embezzlement and Abuse of Office.

His jurisdiction includes Childress, Carson, Hall, Collingsworth, and Donley Counties.

There are more charges to come, charges of a sexual nature. It has got to be a bad day for a man who has spent the last 30 plus years as a DA and Judge to be in the County Jail where he has sent so many people. But he is deserving. Believe me.

Just amazing. He will be charged in the crimes involving the girl with the Aggravated Sexual Assalt also. She is the article on the bottom.

oh dang...that will suck for him.

I've always thought that those in prosecutorial roles and judges should stay well clear of any ethical/criminal boundaries. Defense attys however...it may be good business to go to prison.

SuzyQ,

I believed the same way you do when I was in law school. When I got out I wanted to be a professional prosecutor. I ran and was elected into office. I served my time and have been a Criminal Defense Attorney ever since. It is one of the few remaining specialties in the law where you can still make a living and be completely ethical. I know that sounds funny sitting on the outside, but it is the truth. Go ask Dan Benson what I am talking about. He can explain it easier than I can on an internet board.

AND blw-

No, I am still not missing it. But I hate that I missed the party at the courthouse last night when the indictments were returned. I promise, it is going to get interesting.

Killer K - will you elaborate (on the "only areas of the law where you can be completely ethical"?

I had Benson for Crim law last year. I know the TPC like the back of my hand (well, at least I USED TO).

I take it you don't practice anymore? Why?

I don't see a connection between the two stories that you linked.

I used to have some respect for these guys, but we see more and more cases of them playing games and abusing the system. It sickens me.

PB-

The Wilks girls in the article who was arrested on the Agg Sex Ass. That was the Judge's girlfriend. He was in the closet filming her in the act with the young boys. His indictment will be returned later. The big boys (AG's Office or the US Attorney) typically like the press. So that indict a person once. Then wait for the press cycle to work out, then indict them again on another unrelated charge to start the press cycle again.

That is the connection.

It was always more exciting off the Caprock than on top of it!

I still practice. I specialize in criminal defense and have for 10 years now.

I too had Dan Benson for Crim Law. He hooded me at graduation. I have not see him in a long time, I still have great admiration for him.

I am sorry that I said that about ethics. Brandon does not have enough bandwidth on the site for me to answer that question. It took me 4-5 years of practicing law before I could see it myself.

I may be at the school for the Prarie Dog CLE. If so, I will be happy to explain.

PB,

Yeah I did. I was two years behind John David. And just ahead of Dwight McD.

I have not seen John David in 17 years. But I talk to Dwight every couple of months. He is in Lubbock.

JD doesn't practice. He worked in SA for years as an operations manager for a playground equipment company. Now, I think he is in SLC, Utah, but I can't remember exactly what he is doing.

Dwight was a heck of a good guy and I have rarely seen him since high school. Tell him hello for me the next time you speak with him.

Dwight is something else. We have a great time at seminars. I will let him know.

From what passes as a newspaper in Amarillo:
quote:
David McCoy, facing two felony indictments relating to abuse of power, has filed for re-election as 100th District judge.

McCoy filed as a Democrat and will face Republican Stuart Messer, the 100th District attorney, in the general election.

...

Childress County Sheriff Mike Pigg said the Texas Attorney General's Office brought the case against McCoy and will act as the prosecuting agency - not the district attorney's office led by Messer, McCoy's political opponent.

McCoy's trial date has not been set.

Pigg said McCoy's trial likely will start in March or April.

...

The State Commission on Judicial Conduct suspended McCoy without pay until further notice by the commission after a Childress County grand jury indicted him Nov. 29 for alleged abuse of official capacity and theft by a public servant.

...

Judge George Gallagher of Fort Worth, presiding judge for 396th District since Jan. 1, 2000, has been appointed to preside over McCoy's trial.

Killer, I have heard from a good source that the employees in the courthouse cheered when the indictments were served on the ol' judge. Is that true? The judge who has been appointed to hear the case was my roommate in law school and is a good friend from our A&M days. Sounds like the trial will be in Tarrant Co. May try to make it to Fort Worth to watch some of it. And I am the opposite of you. I was ready to get out of the practice of law until I was elected DA. I am in my 12th year now and love it, even though I am not running for reelection.

Yeah, I talked to some of the people who were present. They cheered, they danced, some were so excited that they were crying and hugging each other.

He was a tyrant that put many people through h*ll. Whatever he gets, there will be people in Childress that will not believe it is enough. If you are interested, contact the DA in Potter Co. He had to deal with him for two terms as the 100th Judicial District DA.

Yea, the DA in Potter Co. and I are good friends. I am calling him now. I am hearing the good judge is entering a guilty plea, set for late March.

Did you get to talk to Mr. Sims? I am sure he had alot to tell you about the former judge.

If you hear the details of the plea, please let me know. I will be upset if it does not involve jail time.

quote:
His courthouse days are over and so are the cases against him. Indicted Childress judge David McCoy has now reached an agreement with state prosecutors.

He's trading his resignation for an end to his legal troubles. State prosecutors are dropping charges of office crimes in exchange for several more things from McCoy. He must forfeit his law license, never again seek any public office, and pay 20,000 dollars in restitution. The 100th district grand jury indicted him for theft by a public servant and abuse of official capacity last November.

McCoy's attorney Bill Kelly says the deal is the best outcome possible. The cases are dismissed, there is no plea entered period, the presumption of innocence... prevails, said Kelly. State prosecutors at the courthouse declined to comment on the agreement. They can no longer prosecute McCoy for anything currently under investigation. Despite his suspension since the indictment, McCoy had been running for re-election.

His name is still on the primary ballot for March fourth, however that will no longer count. McCoy will get to keep his full retirement benefits after serving nearly fifteen years as district judge.

I never saw a criminal defendant come into his court and get that good of a deal. And they were just common people, not elected officials.

Sad day in Childress, no doubt.

I am still not certain if this also terminates any possibility of future charges on the sex crimes. I guess we will have to wait and see.

The AG's Office really showed their poor quality of prosecution on this one. My first year in office I was investigating our former sheriff for misapplication of funds. I wanted to get the AG in to handle the case, but the Texas Ranger talked me out of it. He had too much experience with the AG office. I went with the Ranger. One of the best decisions I ever made. I have a music box that plays the War Hymn that my wife gave me. Any time I had doubts the Ranger would get that and start playing the War Hymn. It worked. Great professional memories.

The Ranger that I worked with in the Panhandle was the one that did the investgation on Ross Margraves and the A&M financial fiasco.

He is pure class.
