A couple of months ago a guy in a work truck rear ended me going less than 10 mph in stop-and--go traffic on 290. I'm just now getting around to dealing with it.

The damage is minor, but it's not nothing. The trunk lid is bent, the bumper is gouged, i believe the frame around the trunk is bent a little bit.

Anyway, the guy wants to pay out of pocket instead of having it hit his insurance. I can appreciate that, but I'm not sure I want to play that game. Filing a claim, dealing with the insurance co on repair, rental, etc seems like it may just be cleaner.

Any advice or guard rails for dealing with a situation like this?

Had a similar situation a couple months ago. Guy in a tow truck took his foot off the brake and rolled into me at a red light. He really wanted to pay it himself and keep it off insurance. It was a very minimal impact but his grill guard gouged my bumper and put a vertical crease in my tailgate. Nice enough guy but If you don't know them you can't trust them. Also, my insurance covered a rental while my truck was in the shop for a week and a half. I doubt he would have been willing to cover that. Do yourself a favor and just contact insurance.

Chances are when he sees the estimate and cost of a rental he will choose insurance anyway. Trunk, bumper, frame, rental, etc. I'd guess you're looking at 4-5K

You have it in writing that he admits fault? I'd get that first before contacting insurance in case he changes his story.

Especially since it's been "a couple of months" since the accident occurred.

If I was the at fault driver, I'd be pretty ticked the OP took months to move forward with a claim.

Thanks all. I'll just file a claim. He rear ended me on 290, there's no dispute about fault. And there are extenuating circumstances why I didn't deal with it right away, I'll leave it at that.

Yep, they'll suddenly claim you were actually at fault. Happens every time, it's why dash cams are so important

Insurance. If he hit you from behind, zero way it's not his fault given the scenario in the OP, but I guess they could try. Either way, I don't want to f--- with that. It goes through insurance and let them battle all that junk out. Unfortunately, this is not a situation from Mayberry in 1963 where people are worth their word. Plus, you said a work truck, so is this going to involve commercial vehicles? I just don't like anything about this....I'd let your insurance premium start working for you, my friend.

I was on the flip side of this. Accidentally backed into a guy. He let me pay him and my ins didn't get creamed.

Mayberry still exists in Lubbock.
