2012 4Runner 2WD



Wife was pulling out of parking space and had stopped to shift into drive. Work truck didn't look both ways and backed out into her as she was stopped. Not her fault.

Back glass is gone. Tailgate won't open, and I think the trim on the inside is busted. Not sure anything can be reused. Bumper is creased in the middle. I'm thinking $7500? $5k for tailgate work and $2500 for bumper?

Ouch! I'm guessing $12k. My son's CX-5 was rear ended 2 years ago, and the damage looked pretty similar to yours. Went through insurance, but the repair bill was about $8,500. They replaced the entire liftgate as part of the repair.

A work truck you say? Commercial vehicle hit her?

I don't see how you can repair that without a full gate in new or LKQ.

Yeah, kind of hoping they don't argue a bunch to avoid a lawyer. Don't intend to go that route at all, but I would like it fixed like new.

great guess. my wife's 4runner was in a similar accident earlier this year with basically same damage and that was pretty close to what hers cost.

That's one thing that really sucks about repairs on an older, but very reliable vehicle. I'm sure that 4Runner is running pretty much like the day you bought it.

Yep. We got it used, but it only had 65k miles and ran great. Had it for maybe 6 years now and it's been great. It's at 125k miles now and doesn't even use any oil yet.

My wife backed her 2018 4Runner into the pin box of our 5th wheel last November and caused very similar damage. Total bill was $5,500. Replaced the lift gate, bumper cover, glass and repaired some interior trim.

I'm interested to see if the business pays up. I had a tow truck try to make an illegal left turn into a gas station. I just so happened to be waiting at the light just before his turn and he cut it too close and tore up the rear end of my truck.

He admitted it at the scene, gave me his ID and insurance but a week later denied the entire thing and said I was at fault. Thankfully I had a witness in the next lane that gave me his number in case of this exact scenario. After the businesses insurance talked to my witness they paid up and told me they were going to have the driver fired...I have no idea if that happened.

This was cost to the initial estimate from a body shop. I think full estimate will be around $6500-$7000 because he missed a couple of things before he gave us that number.

A-hole who backed into her has changed his story and now says they backed into each other. Their insurance doesn't want to take liability. Business isn't releasing camera footage to anyone but police.

Any advice on moving forward? Lawyer? File under our own insurance and subrogate?

I would first try contacting the police to make a report, request they obtain the camera footage since the business is not cooperating. Then request video from the police.

In my experience( I've had a few). Police do not get involved in a civil matter like this. Only if there was a crime.

I would list all of your wife's injuries and nagging pain symptoms. I would then say we're willing to waive all future claims in lieu of them paying for the car damage claim.

May work….may not. Worth a try as I don't think hiring a lawyer is worth it unless she really is hurt.

Did that. Police said they'd go with my wife to get it, but business is saying they'll only do it as part of a criminal investigation or with subpoena. Pretty sure insurance company should have a later who could take care of that, but they have no interest.

I don't know any business that would release footage to the public. There are potential privacy concerns and they are under no obligation whatsoever to release their footage to the public.

If a police report was filed, and an investigating officer requested it, then they might release it to the police. Some businesses will do that.

File it with your insurance and let their lawyers fight it out. I strongly suggest either you or they have a lawyer send a letter to the business requesting that they not destroy the camera footage pending incoming legal action. If their camera footage supported their driver's claims, they would certainly be sharing it with you to get you to go away.

Business isn't the insured party. It's the gas station they were both at. They said they keep it for 90 days. We just filed with our insurance.
