Delayed Registration when purchasing used vehicle

Howdy,
I purchased a used vehicle in DFW at an OEM dealership about 40 days ago. I highly doubt the dealership is doing anything sketchy. They are saying that they are trying to obtain the title from the auction they purchased the vehicle from and it could take another couple of weeks. Should I have any concerns?

40 days is bordering on a problem. Dealers can sell cars they don't have physical title of, but the expectation is they will produce in 30 days.

I wouldn't think dealership scam, but there are definitely concerns about the auction house being able to clear liens, match VINs, branded/damaged title, previous owner dispute, etc.

I'd get something in writing (email) from the dealership stating they expect the title on X day, what they think the delay is, and what the webDEALER status is. I'm not an attorney and don't live in Texas, but most states have an unwind window that you can request if they haven't produced the title in so many days (it was 45 in the last three states I bought a car in).

Maybe they'll toss in a few oil changes due to the delay.

When talking with the title clerk - she said this isn't too bad. She mentioned that she was still working on some titles that are 6 -7 months out! I googled up and didn't find too many people complaining about this

Ok, that's a whole new wrinkle. That suggests a very serious compliance problem with that dealership. Texas law says the dealer has to transfer title to the buyer's name within 30 days (using webDEALER). Admitting they have some very long delays sounds like "oh 40 days is nothing" to the buyer, but it kinda signals that the dealership regularly buys at auction and resells without verifying that they can cure the title at all.

Unfortunately, you're on the hook for registration delay penalties, insurance claims being denied in an accident, tickets for driving an unregistered vehicle, and resale complications. I think you need to get the dealer to respond via email with an expected completion date, what they think the hold up is, and a concession that they will cover late registration penalties. I'd also say something like "if this can't be resolved in the next 10 days, what are our options to unwind the sale" or something. Ask specifically whether they have filed the title application in webDEALER.

Tell them you will file a complaint with the TxDMV Enforcement Online Complaint System if the title is not solved in 10 days. This is their administrative lane to ensure dealer compliance.

Edit- dont let them waffle on bs like "we'll take the car back on trade for something else." Unwind is not trade in

Purchased a new vehicle from an Austin dealer Jan 2nd. Took 6 weeks to receive registration, 7 weeks for title.
Dealership and county both said the process has been very slow. I guess I'm good with under two months. Best of luck to all.
