If you're paid to play, you're under a financial contract with the university.

Did he break it?

Simple answer. Yes.

More complicated answer. So what.

There are no rules right now.

I'm assuming an argument is going to be made that since contracts aren't pay for play (oh sure sure), Duke has no right to restrict where he plays. On the flip side, I would think Duke/collective could stake a claim to all of Mensah's NIL.

NCAA got way out over their skiis on NIL. It's still the Wild West, but it's starting to turn. I'm hoping these young men are about to get a quick lesson regarding the value of a contract. They aren't signing a renter's agreement - they are signing a binding contract with a very lucrituve reward for someone their age.

As Trip says, there will be more and more of these situations until a legal precedent is established.

This isn't an NIL contract. It's part of the revenue share under the house agreement, so it is pay for play.

Burn it down. They want university money via donors but they don't want to be obligated to the university. Go join some minor league football league that has no ties to a school (thus no fans) and see how much money your football skills are worth. If people are only watching because you have such great football skills then I am sure they would pay to watch you play anywhere.

So the NIL deals can't be pay for play but what about the rev share portion? Which I'm sure this is about I would think it gives the school a little more stability then the fake nil deals. Will be interesting and hopefully sort out some things.

The players want to get their cake and eat it, too. Sign a deal to get the most money you can, then bolt as soon as someone else offers more. I'm 100% on the side of the schools and I hope they are able to enforce these deals.

I wish the players would unionize and negotiate a CBA. Then at least we know what the rules are.

V unlikely gonna stop anyone from exiting a contract if willing to pay the liquidation costs or clawback.

Right to work.

This will likely lead to Unionization. Which was one of the biggest drivers early on ('90s?) for players to be paid.

If you sign a multi-year contract, are you not obligated to fulfill it?

Is there any accountability in any of this?

It's gonna be hilarious when these brats get to the nfl & realize the idiocy is no longer allowed

Most states dont have "Right to Work" as most States dont protect employers. Unfortunately, a unionization and collective bargain is the only way College Football survives in my opinion. Its sad because if there is one thing the United States has contributed to the world its the evidence that unions dont work. But NCAA is losing power more and more each season and will be backed into a corner.

NCAA got pushed over a cliff by the courts. They're not making decisions, they're making, being overruled, and then told to try again until no one sues them.

The universities need to unionize and realize they have power too. There is very little market for football that is not tied to a school. The NFL already occupies that arena and every league that tries to compete with them fails.

Did he break it?

That depends on the length of the contract.

Can't wait till we have a player who enters the 3rd Quarter Media Timeout Transfer Portal and lose them to LSU.

I was one of the few who was always against "just paying the kids" for what it would inevitably and immediately become.

They're pros now, and the only answer is collective bargaining and league rules preventing shenanigans like this. And eventually the athletes at the highest level will question the requirement to attend classes on the grounds that a bad sociology grade will hinder their ability to earn.

The endstate is pro teams owned, operated, and licensed by institutions of higher learning. It's all a matter of how we get there.

a kid from Georgia left to go to Mizzou right after signing an NIL deal and they sued

just a few weeks ago the QB from Washington announced he was going in the portal. The school immediately questioned and either sued or at least threatened to sue. He quickly decided to stay at UW

Or, we go back to the old system where kids are paid via free education, free room and board, free meals and free training.

Theoretically if Duke has proof of tampering could they sue the player and the school that tampered for amount of the NIL contract? Or could the entity funding the NIL deal sue the other school?

Are the terms of the contract even publicly available?

None of this blathering means anything without knowing what the contract says. It's the Zoo....so blather on, but....

Duke quarterback Darian Mensah is permitted to enter the transfer portal, but he can't enroll at another school or play football for another college team before a North Carolina judge rules on Duke's request for an injunction that would prevent him from leaving.

An injunction hearing is scheduled for Feb. 2 in front of Durham County

Make it like coaches contracts, include a buyout.
You want to transfer? Ok cool.....you or the school you're going to is going to now owe us X amount of money to buy out of this contract.
