Agree with your take as well. It really should not be a significant time nor cost and as mentioned BSA probably does it for them. That's what's the strange part to me is.

I'm guessing they're wanting to operate their own thing separate from BSA. I think there've been some groups in that world that are still trying to have that model but not specifically under the BSA umbrella.

That's 100% guesswork on my part but fits some of the aspects of some of those other groups.

Ironically it's exactly what he's say….his whole persona was a lie built for attention. Photoshops, career histories, celebrity encounters, wealth, you name it, he lied about it.

And the thing that's interesting if you're the one that highjacked this thread.

I alluded to going to jail for a reason. I think on its face, it's could get him in trouble with the IRS.

Even his staff accountant advised against it.

I appreciate his benevolence, but running a fire department has nothing to do with Boy Scouts.

I had a friend try to setup his sons little league baseball team as a 501c3. I understand the desire to not have to pay the feds a dime more than necessary

As much as I want to minimize taxes and not pay a penny more in taxes than I have to, I do think it's ideas like this that get people in trouble with the IRS.

And assuming you can twist around and find an angle that works, is it really worth the level of expenses we're talking about here?

I wear a Barnes accusation (happens in f16 from time to time) with a badge of honor. Folks let it get under their skin a bit too much and you guys are right, that actually makes me think someone may indeed be another incarnation.

For the OP, think you have the internet of advice of a) do your research into by exactly this BSA troop wants to operate this way; b) direct them to BSA for their own tax exempt status; c) if someone needs an unusual enough arrangement that you ask TexAgs for advice, then your gut reaction should always be "this is probably not the best idea".

Be safe with the VFD both personally and fiscally. Having to auction the fire truck off because you got bad advice on tax exempt status may endanger your standing in the community.

The chartering organization "owns" the scout unit, so it can share the tax exemption, but as mentioned previously, they must then follow the appropriate 501c3 rules. Our units are chartered by a church and utilize the tax exemption for purchasing some items for the unit itself, but the items are then owned by the church. Our funds are so miniscule compared to the church it usually isn't scrutinized very much in my few years of experience with it. The church has a representative (chartered org rep) that is on the bank accounts so gets statements of activity. We always tell anyone who wants to donate directly that they should donate to the church itself if they want a tax receipt, otherwise it is a non-deductible donation. Disclaimer: I'm just a relatively recent volunteer and not at all a tax expert.

To put this issue to bed, I have decided, and will pass my recommendation to the rest of the board, that the department will be happy to sponsor the pack and provide meeting rooms and storage. But, we will not participate in the Fiscal Partnership. The decision is based more on the fact that our office manager has too much on her plate already. She does not need further duties tracking donations and dispensing them appropriately.

I see Stive couldn't take his own advice and avoid engaging Barnes. It's just too hard to resist.

Oh, and anyone calling Stive a joke on the B&I board is the real joker. Sheesh, read the room Barnes. This sock is done.
