It was a big surprise to me that the same HR indicated now that there is a policy to not buyout severance and there was No money offered to bridge the gap.

It's a huge benefit in that if I couldn't find a job, I have full pay for a year and full insurance paid for 6 months. So it was provided to show the value as one of the considerations is to walk away from those benefits to take the job, which I will not consider.

So to update, I went to management and HR and have a tentative agreement to move up my date 4 months. Prior to this, the new job agreed to push the start to 2 months from now. Unfortunately, it leaves a 40 day gap that neither will work with.

Technically, I could play that game as law requires separation to be announced 45 days prior to the date. I then have the option at anytime to sign and leave. So I could sign and leave 40 days prior to the agreed upon date and start the new employer and it would work. But it's too shady when the new job is the one being the most unreasonable. These are both large employers. The new one is the largest in its industry.

Frustrating…the post date of the job and my needed date to start is only 5 months. For an upper management level job in my niche field, that's very reasonable. I did everything I could and took a risk by going to my employer. I'm content with walking away and hanging out to get my severance.

Man that's so frustrating that the situation doesn't look like it's going to work out. At least you shot your shot for the potential opportunity. Thanks for keeping us updated.

It sounds like you have a path to thread the needle. I was skeptical that they'd work with you on an earlier exit, and you got them there on that. If the law is on your side to move it up another 45 days, what's the harm?

On the other side, there may be some concern that you don't get out on time. In executive hiring, a delayed start is generally ok as long as the hiring company can get comfortable that you'll actually show up on day one. Also, depending on the role criticality they may decide that getting their second choice in the chair sooner makes more sense that waiting out the top choice.

If it were me, I'd quickly consult an employment attorney to see what the path to threading the needle looks like.
