Legal recourse for a bad roofing job?

I had a new roof installed in Oct of 2020. I have recently had issues with my dryer not drying, so I called a company to clean out the vent. Turns out the roofing company completely blocked off my dryer vent and we also found a slight leak near where the dryer vent is connected to the roof. As of right now, the roofing company will not return my calls. Any insight would be appreciated.

What company? Im going to need a new roof in Montgomery County soon and want to be sure not to call them. Although roofers and contractors can and usually will change names on the fly.

Get a quote to fix the problem and sue in small claims. Probably cost $200 in fees. It may get his attention enough when he is served to address the issue. Otherwise proceed and win a judgment. Though you probably will have a hard time collecting any money.

I would get a quote and send a demand letter by CERTIFIED MAIL and demand repair in 30 days. After 30 days file small claims court

Get it fixed and move on and bad mouth that company every chance you get. That will cost him a lot more.

Very common in new construction.

Ours essentially goes straight up about 15 feet and then makes a 45 degree angle and goes another 20 feet to finally get out of the roof.

It needs to be cleaned at least every twelve months. Kind of a pain in the ass

I see a lot of this in my home inspections after re-roofs, but I see more gas flue vents that are separated than dryer vents. If you have any gas appliances with flues to the exterior make sure you check them too.

If the utility room is located on an exterior wall, the dryer vent will go directly out through the exterior wall. If the utility room is located on an interior wall, the dryer vent will typically be routed through the attic and be vented through the top of the roof.

Maybe, but if it was an insurance job to begin with, wouldn't this be warranty work? If the roofer won't answer, insurance still typically warranties, right?

OP can contact them. Not much to a call or two. My experience with insurance companies is they won't do anything unless they have to

1) They have no Google Reviews which mean they are newish to the area and very small, they likely do not care about their reputation. Or, since the work was in 2020, they make not even been in the area anymore since it appears they are based in Tennessee.
2) It's unlikely they have insurance but if they did it would probably only be general liability which does not include coverage for "workmanship". This mean repairs to the roof due to bad work is not covered but it could cover damage to other areas that were not a part of the roof install like water damage to sheet rock caused by the shoddy work. I
3) Might be cheaper just to move on but be sure to put a bad review for Google, Facebook, yelp…etc.if they continue to fail to respond. I do not find a BBB listing which is not surprising.

Because local roofers get swamped for months. I've seen a one year backlog before with some local roofers following hailstorms.
Also the out of town people tend to do illegal things such as waive or pay your deductible which makes cheap people jump all over signing contracts with them. If your contractor is willing to join you in committing insurance fraud, what else will they lie or cut corners on in your job to make up the difference ?

This has been common for over 20 years now.
It's not ideal and I have cleaned many that were 100% blocked and were major fire hazards but when an exterior wall is not feasible, they will always go up. The longer the run the easier it will clog up.

The warranty is likely provided by the roofing company themselves - usually a one or two page document. If the company doesn't have physical office or representative in Texas, you are pretty much out of luck. If they do have an office, you can send them a certified letter making a demand and then follow up with a small claims case if they don't respond. In any event, the odds of collecting anything aren't good. Live and learn. With a roofing job, it is best to go with a local company that has been in business for over ten years with a good reputation.

I recently addressed and issue like this but regarding a loose water heater vent. In that case, the HO was able to get in touch with the roofing company and while they dodged the issue and refused to fix it, they eventually told the HO to have it fixed by another roofer (me) and send them the bill. That's what I did. Then the roofing company called ME and asked 400 questions about my qualifications in an attempt to shirk the bill.

Eventually they paid the homeowner and then I got paid.

So, are they not answering any calls at all? Do you have any photos of the issue? Honestly, fixing an issue like you describe is going to be less than 500 bucks and court is going to not be worth it.

It sounds like they used a trap door vent but failed to remove the bird screen from it, which it explicitly states to do in the directions in the box if you use it as a dryer vent.

I lived in Houston a long time and did a lot of roofs over there over the last several years. I've never heard of that company but there are a LOT of small ones that pop up during new storms. That particular one is a fly by night based in Tennessee. Their second number for certain changes periodically based on storm region.

No, the insurance company does not warranty the roofers work. The insurer pays for the damage roof, but they have no control over who the OP selected to repair the roof, or control over roofers to make them honor their warranty.

I just assumed it was like auto. After getting our car back from our accident, our transmission and suspension (both replaced after the wreck) went out within a year. Our insurance handled getting the shop to fix the issues. We just had to drop it back off, and they supplied a rental for us.

Yeah, the carrier doesn't have to do anything. The roofing industry is nearly completely unregulated. Did the roofer pull a permit? Did the inspection after it was done pass? Do you even require one where you live?

I'd call the main number and see if you could get another roofer to make the repair and have them pay the bill. That's what I did on the job I referenced earlier. It was the best way for them to shirk the Fix but pay the bill and not have the customer absolutely dEstroy them on social media.

If that fails, I'd have it fixed on your dime and chock it up to experience. I send my customer insurance, references, my Facebook page, my companies business page, my business page, and my business card has my photo on it. There is no way I'm walking away from an issue Or an unhappy customer. I want my customers to know that I am accountable and that what I do is not some side hobby. My customers are generally my own neighbors and I treat them as such.
