HOA fees - Services not being provided

We are about to move into a new subdivision. In the CC&Rs for the HOA, it states that the monthly assessment includes internet service. This is supposed to eventually be fiber optic service from the local provider. The subdivision is probably about 2/3 complete. The fiber optic line is not installed yet, and up until recently, the provider was renting out little line of sight dishes to the residents and providing internet that way. However, this provider has now said they have no more equipment to rent out, and can not or will not give a timeline for when the fiber optic will be up and running. New owners are moving in, paying HOA fees, and not getting internet in return. We close in about a month. If this isn't resolved by then, what are our options, since the CC&Rs stipulate that internet is included, but it's not being provided?

Does the developer hold a vote for each lot until such time that the subdivision is X% sold? There might be some legal recourse but from a voting standpoint you're SOL if the developer still holds the majority vote,

Yeah, they get something like 4 votes for each unsold lot, so I think they have majority vote still. The developer did just transfer the HOA management to some new company, so I guess asking them questions is my next step. Thanks!
