Need advice on developing/subdividing lot

We are purchasing a lot near town (outside CS city limits but within ETJ) of about 10-acres that we will be paying a premium for because it can be subdivided into smaller 2-acre lots. The seller has plotted it out including allowing room for a future road that the county would maintain. It has passed zoning, but some modifications were recently made.

There are easements, adjoining properties and other considerations that need to be taken into account that we don't want to make mistakes and find ourselves in a problem legally. It seems like a good investment but we just want to run due diligence.

Who/where would we find an expert/advisor that is specific to development to be able to run this by? Seems like a real estate lawyer, but I'm thinking more of a developer lawyer or city planner?

You need a land use attorney and a civil engineer. Call the land use attorney right now.

2nd talking with a civil engineer to begin. When you say that the "seller has plotted it out" do you mean that the 10 acres has already been platted into individual lots? Or do they just have a conceptual plan? Other considerations:

-Detention and requirements? Where does the water drain?
-Water source? Are you obtaining from someone else, or will each lot have its own well?
-Sanitary sewer? I assume each lot will have their own septic system.
-Power, gas, cable?
-Any floodplain issues? Will you need to bring in dirt to raise lot elevations?

Also, you're paying the premium because it's an ETJ property and you can technically put whatever you want on it. It's being platted into two acre lots because that is almost certainly the smallest lots that the county subdivision regulations allow for if there are no sewer lines.

Also, there is no zoning to passed approved in an ETJ. It sounds very much like this property is about to be annexed.

All of this will go through the commissioners court or whatever committee the city has. Just get on their agenda abd ask your questions.

Don't need to pay an attorney until you need one.
