I think so. Especially after reading the thread posted by the guy who wants to sell the owner-financing mortgage he has. Sounds like a very similar situation. Except the guy in my story isn't actually on the mortgage. So I assume none of this is hitting his credit.

Makes me wonder how many times you can go back and forth like this.

I don't know how this could be the occupants "strategy". How does he have any control over the auction process?

It's his strategy for keeping his ex-wife in the house without making regular payments.

Similar to the other thread, I think he doesn't pay for as long as he can and then makes a "Hail Mary" payment to prevent the auction. He knows the exact day and time that the suction is scheduled, so all he has to do is make a payment before that.

Like I said, this was the 6th time this house was scheduled for auction and then pulled.

I thought the other dude's strategy was declaring BK, rather than making a one lousy payment.

I thought the OP in that thread said he'd done both. Maybe I'm not remembering correctly.

The two situations aren't exactly the same, obviously, because the guy in my story isn't on the mortgage. But they are both scammers who pull some last minute stunt to stay in the house.

Edited to add that I was thinking about this post.

I have filed foreclosure 5 times previously. 3 times he filed bankruptcy (all dismissed due to paperwork not being filed, and/or payments not received). The other two times I made him pay 2 months of mortgage to stop the foreclosure. He does what needs to be done to stop the foreclosure, then stops making payments. Since December of 2019, he has made 12 out of 37 payments.
