Title Policy for Tax Sale Property

I bought a tax auction property in the Houston area and am looking to get a title policy now that the redemption period has passed.

Does anyone have a Title company recommendtaion for this context? I found a group that specializes out of California, but looking for someone more local if possible.

Appreciate any help. Gig 'em.

You're "looking to get a title"...you have title to the property. Are you looking to get title insurance?

I'm not a real estate attorney but I'd like to read any cases awarding title to someone with an interest that survived a Sheriff's Sale over the Sheriff's grantee.

What would title insurance protect against after a tax sale?

I own a Title Company.

The Sheriffs Deed that was filed with the county clerk is your title.

You can get a title policy from a company licensed to sell Title insurance in the state of Texas. The title company will probably want to make an exception to the redemption possibility on your title policy.

Save for the redemption issue, encroachment issues, and property taxes, it has been my experience that a completed foreclosure via sheriff's sale does a pretty good job of washing the title. Not sure I would spend the $$$ on a title policy for a property I already owned for which I just received a sheriff's deed. Now…..depending on cost, I might be willing to pay for a title search. Of course if you are going to borrow against it, the lender will likely require a lenders title policy.

As stated, consult a real estate attorney.

Now, with that said I've never done one of these but I would probably have a title search done on it to make sure the title is clean.

It is a pain in the ass to have some person who had an interest in the property 100 years ago and died with very little record of heirs create issues if you try to sell it. Get ahead of any potential issues.

I would ant least order a title commitment and see what comes up but my question is why didn't you do that before you bought it since you knew the redemption would be an exception anyway.

Agreed, but I've never done anything with a sheriffs deed or at a tax auction. Maybe they consider the sheriffs deed to be sufficient and if you don't like it then don't participate?
