How long do you want to ignore this user?

Are there any construction law types on here, preferably in the DFW area? I'm looking to file under Chapter 27 for failure to repair.

I had a patio built last April and the roof leaks into the walls of the main structure of my house. I've messaged and emailed the contractor 6 times and he has said "we will fix it, we will get to it, I'll send a guy out next week, etc" and it still hasn't gotten done.

Just looking for some advice/direction before I move forward.

If the guy has insurance, try to file against it

General liability will likely not cover any workmanship issues but could pay for repairs for the damage to the home that were not a part of the original scope, such as the damage from the water intrusion.

It will likely require a letter from an attorney, however, to get the contractor to put their insurance carrier on notice, assuming they where insured to begin with. I do not suppose you got a copy of their insurance certificate before starting work?
