Residential Lease Back - Smoke Detectors?

I am considering purchasing a house that I am planning to demo. However, to get the deal done, it seems I may end up having to do a lease back for potentially up to 6mo. The realtor said the leaseback form is fine for month 1, but I really need to do a formal TREC lease form for months 2-6 because that lease back form does not specify remedies for breach on either side and is really meant to be short term.

Both of the TREC lease forms say I must install smoke detectors. I am assuming for liability that I need to do this? Seems a little ridiculous if I am tearing the house down and doing this as a concession to make the deal, but I guess I have no choice per the Texas Property Code and liability. Thanks in advance.

You could roll the dice and wait for them to request them then you have time to remedy. Being that they didn't have them they probably won't care.

Also, be careful and make sure your mortgage company understands that you will not be occupying the home. People have had issues recently sayong it going to be their primary residence and then doing longer lease backs.

Smoke detectors are not that expensive. I'd put them in if the install is not crazy.

4-5 smoke detectors with a single screw for each one. 15 minutes at lowes. 15 minutes total to install. Take pics to document. Find bigger problems to worry about.

Thanks all. Yeah, just going to install some. I didn't realize you could get them as cheap as you can.

I'd make it a condition of the sale. "Seller shall install smoke detectors per xyz" you want to lease back, you make it leasable.
