Please hire an attorney to do stuff like this. It's not that expensive. I can put you in touch with the one that I'll do it for probably $1,000 or so.

Thousand dollars to fill and file a 3 page form seems excessive.

Seems the most critical thing is to get the legal property description correct.

A lawyer we've contacted has recommended against TODD. Said if we go to sell, mortgage may be difficult to get b/c of title issues. Have you any experience selling a property less than 2 years where deed has been transferred by TODD?

You aren't paying $1,000 for the time to fill in names and dates on a 3 page document that gets filed. You're paying for his knowledge and expertise, which took him years to build up, and he already gave you such that you averted a potential pitfall even before you did it. I've dealt with a lot of "ladybird" deeds, but I'm not an attorney and I don't know your situation or the law like an attorney does. You kind of just showed that you need an attorney for something like this, because not working with one can put you in an even worse situation than not filing the document at all because you acted as your own attorney instead.

Ok. No help. The estate lawyer who did the will says we don't need a TODD. Cause the will "covers all the bases", and we can just file a Affidavit of Heiirship to get them out of probate even tho everything I've read says you use one of those when there is no will. We just want to get the properties out of probate and the TODD accomplishes this.

Maybe we need another lawyer.

Did your buyers/sellers have problems w/ Lady Bird?

No, because they worked with attorneys who were familiar with Texas law and my family's and my client's situations and used them appropriately.

We had an easy TODD situation on a condo in Brazos County in 2024 when Mrs. Schwack's Mom died. A couple years before she passed we spent time with her fine tuning things & looking for ways to make things easier to settle so that we didn't have to go into probate. Downloaded the files online & carefully filled everything out & filed at the courthouse. When she passed, we had no trouble selling the condo even though 3 heirs were named in the TODD. We did not have to probate.
