3 years. We have the listing pics from when she bought the house. Its obvious this is her handy work. So right now we've shutdown the kitchen sink, dishwasher etc. and won't be using our washing machine either until the piping is fixed.

As a lawyer...and assuming you are going to file a lawsuit on this (and you're not my client) I would suggest you not share too much more on this tread, as all of this is discoverable.

You know the issue. You know the alleged misrepresentation/active omission of fact. You will need to find out how much the fix will cost. Let your lawyer handle it from there.

If you were my client, I would advise you to stop posting on TexAgs about this issue.

Pretty sure caveat emptor does not apply to fraud and deception from the seller. They can stay silent and fail to disclose, but they cannot lie when specifically asked for information and knowing hide damage, defects, violations, or anything material that would affect the sale. You can absolutely win a judgement for that, even in caveat emptor states.

If she wasn't actually tied into city sewer, had a hidden, undisclosed pump and buried, unprotected electrical cord to power it, and failed to disclose it when specifically asked about pumps on a legal disclosure, that's absolutely material information and fraudulent representation.

Regardless, Texas is also not a caveat emptor state. Lying on the disclosure opens you to all kinds of liability and could even be a reason to void the sale. If I were OP, I'd sue this ***** into the ground.

Thanks for the feedback ABATTBQ11. I chose a plumber to fix everything to code. It's going to be just under $10k. We're going to do what we need to. I can't stand a fraudulent person.
